CALL CENTER THREATENING TO TERMINATE EMPLOYEES WITHOUT JUST CAUSE

Hello Attorneys,

yung pinsans ko po ay isang call center agent. problemado po sya ngayon dahil 20 sa kanilang department ang sinabihang iteterminate sila dahil may isang metrics sila na hindi na-meet sa buwan ng march.

sa call center po ay may monthly evaluation po sa husay ng agent sa pag-english. sa call center po ng pinsan ko ACE ang tawag doon. yung policy daw po nila ay makakatanggap ng 1st warning ang agent kapag bagsak sa evaluation ng 3 straight times. tapos yung nabagsak na agent ay itratraining uli. pag nabagsak pa uli, may second warning sya. pag bumagsak sya uli ng pangatlong beses, termination na ang katumbas.

pero ngayon daw ho sa buwan ng march kapag nag fail sa english evaluation ay sibak sa trabaho. 20 silang lahat ang sinabihan na tatanggalin. wala raw ganitong policia na pinatupad. tapos, ni walang conference na gagawin. basta na lang silang sinabihan na iteterminate sila.
legal po ba ito? ano po ang dapat gawin ng pinsan ko at ng mga kasamahan nya? tama po ba na dumiretso sila sa DOLE? ano po ang dpat nilang dalhin na mga documento sa DOLE sakaling magpasya silang mag-reklamo?

were they already terminated? they should be given a notice to render an explanation in 5 days and an admin hearing before another notice that they are terminated.

i believe they are under some form of PIP. removing them from work should have gross and habitual neglect as basis.

if they are removed from the company, they may file a case at nlrc and contact me for advice.

hindi pa po sila naterminate. pero,napagsabihan sila na posibleng mangyari ang pagtanggal ngayong buwan. may PIP po sila nung uno, pero ewan daw po nya kung bakit basta-basta na lang silang sinabihan na tatanggalin.
sa visayas na call center po ang pinsan ko nagwowork atty. will give you more updates about this issue kung may news sa pinsan ko.
