Kailangan ko po ng advise Atty.

My problema po ako..

dalawa po ang trabaho ko. Isang pang gabi a isang pang araw. Yung mga company po n pinapasukan ko, bawal po yung dalawang job.
Hindi ko po pinaalam sa employer ko agad kasi pag sinabi ko, i hohold nila ang sahod ko until makapag clearance ako sa kanila. habang ng wowork ako sa day job ko nag wowork din ako sa graveyard job at inilihim ko iyon. Ngayon po, natuklasan sa comapny ko. Gusto ko pong mag immidiate resign na pero ayaw po akong payagan ng supervisor ko. Mali daw po yung ginawa ko...

Sequence of events

1. May issue po ako sa boss ko nun, kaya ako ng apply ng ibang trabaho. Kasi po sobrang rude po nya. Ngpasa ako ng Letter of intent na ma transfer sa ibang department. Inireport din siya ng iba kong kasamahan sa trabaho, bale ang nagnyari po wlang HR hearing na naganap.. Pinag usapan lng po yung probelma namen para ma address yung problema



2. Yung inaplyan kong trabaho, natanggap po ako at my magagandang benefits na nakasaad sa contract. Medyo that time di p ako mkapag decide kung aalis b ako ng sa comapny n pinapasukan ko. Naisip ko na "test the water" muna, pag maganda, iimidiate resign n lng ako. Alam ko po yung LAw naten when it comes to immidiate resign, Ang question ko po: ayoko n po kc mag render ng 30 days dahil bawal din po sa isa ko pang company n pinapasukan ko n dalawa ang trabaho, pero yung supervisor ko ayaw nya akong payagan... NCNS or no call no show dw po nya ako..eventually mateterminate dw po ako. Ang question ko po, my karapatan po ba ang supervisor ko ng di ako payagan sa immidiate resignation ko? Pede ko po ba i submit n lang yung resignation ko directly sa HR?

3. In the event na materminate po ako, pede po b ako kumuha ng clearance at certificate of employment sa dati kong company para mkuha ko ang last pay ko?

4. Level 1 employee lng po ako, meaning ang position ko lng sa company ay isang Customer service Agent, mag dedemanda po kaya sila sa aken?

5. Acceptable po b yung situation ko kapag ng file ako ng case sa NLRC?

moderator
you are legally required to render 30 day notice unless the company agrees to a shorter period. if not, you can be liable for damages. you can file your resignation to the HR.

if you are terminated, you can process your clearance, but the company might place on your clearance that you were terminated.

probably not, but there is a risk.

you're resigning voluntarily, not being terminated, so i don't know what case you will file at nlrc.
