Good Day po Atty.,

Itanong ko lang po at kami ay nagkakagulo na dahil dito:

Ang misis ko po ay may Tiyahin(buhay) at may 2 anak(22 at 28 yrs old buhay pareho may sariling pamilya na rin), ang property na pinag-uusapan ay estimated at 1.8 Million pesos.

1. Saan po ba mas makakamura sa pag transfer kung thru Donation or thru Sale?

2. Halos parehas ang kwenta sa tax assesment kung donation or sale - base sa impormasyon sa web sa donation ay yung section 99 at yung sale ay yung 6% ng capital gains

4. Magkano po ba ang estimated lawyers fee
kung thru Donation or thru Sale?

5. May habol po ba yung 2 anak nung tiyahin ni misis sa future kung deed of donation ?

Maraming salamat po at wala akong mapagtanungan na iba kung kayat ang inyong paliwanag ay napakalaking tulong sa aming mag-asawa.

if you are really purchasing the property, then it should be sale. if it is being donated, then a deed of donation. otherwise you can be made liable for falsification of public document and tax evasion.
