This is the story:

Yung lola ng asawa ko, kini klim na nasa mapa nya yung lupa kung san yung bulak na kahoy ay nakatayo. Pinaputol nya yun after makakuha ng permit sa barangay at nagalit ang adopted child pero di naman sila mag ka apelido ng nag claim din na ang kahoy daw ay tanim ng mami nila na awardee ng lupa na nakatira na sa US. Ayon sa mga testigo, yung award ng mami nila is na nullify dahil ito a di na nakatira sa pilipinas at isang dual citizen na. Ito po ang nangyari, yung kahoy na naputol ay nakatiwangwang dahil nga sa reklamo. Nagkaroon ng pag uusap sa barangay at hinold and kahoy. Pero makaraan ang ilang buwan, ginalaw nila ang kahoy at nagreklamo ang lola ng asawa ko na wag galawin. Nagpunta ang asawa ko kasama lola niya kung san yung kahoy, nagtatalo sila.yung pangyayari is malapit lng sa bahay ng complainant pero nasa labas kami ng bakod. Nung tumongtong sila sa lupa di nman sila pipaalis. Nagtatalo sila. Sumunod ako dala ko ang maiit kong anak. Nung dumating ako, narinig ko na pinapaalis niya ang asawa ko at lola nya sa lugar. Nakiusap ako kay kuya, na patigilin na lang nya ang asawa niya dahil hindi aalis yung lola at asawa ko dahil kiniklim nga na sukat sa mapa ng lola ng asawa ko ang lupang yun. Makaraan ang ilang minuto, humawak ng kahoy yung complainant na babae at sabi "Kung di ka lang matanda, kanina pa kita tinatadyakan". Sumagaot ang asawa ko, "Wag mung ganyanin yung lola ko dahil magkasubukan tayo". Sabi naman ng babae yung complainant, bakit, lalaban ka habang hawak ang kahoy at nag attempt ihampas sa asawa ko dahil tumayo siya. Nahawakan ng asawa ko yung kahoy, at nagsabunutan sila. Lumabas yung anak ng babae and complainant at tinulungan nya yung nanay nya at pinagtulungan nila yung asawa ko. Sabi ko sa kay kuya yung asawa ng complainant, awatin mu kuya, instead na awatin, diniin nya yung asawa ko at nag react ako na wag ganyan ang maging neutral siya at habang hawak ko ang anak ko, gamit ko ang isang kamay, inalis ko ang kamay nya sa pagkakahawak sa balikat ng asawa ko. tapos, sinuntok nya ako. May mga tumulong at naawat na ang lahat. Yung cellphone namin nakuha ng kabila at winagayway at sabi, ito ang cellphone nyo tapos makaraan and ilang minuto ng sabihin ko ibalik mu yan, dinideny na nasa kanya. Nagbanta ako na kasuhan ko siya ng direktang pagnanakaw at di nya tlaga sinauli. Nagpabaranggay ako at pagbalik ko, binalik na daw yung cellphone. Yung kwentas ng asawa ko naputol at nawala and pendat. Ngayon, nagreklamo sa barangay ng trespassing at physical injury and kabilang panig. Nagkaharap kami at di natapos dahil na reset yung hearing to show the documents. Ito ang tanong ko:

1. Valid ba yung trespassing?
2: Sa physical injury, pwede ba kami mag contra reklamo dahil nauna kami nagpablotter sa barangay at di lng na aksyunan agad. Meron din kami medico legal for minor injury.
3. Pwede rin ba ako mag demand para bayaran ang araw na di ko pagpasok dahil sa hearing at nangyari if baseless ang reklamo sa akin?
4. Yung blotter ko na direktang pagnanakaw, valid ba ba kahit naibalik yung bagay sa akin?
5. Pwede ko rin ba ifile yung damage of property dahil sa kwentas kahit di ko nasali sa blotter?

1) you had possession of the property so they cannot claim you were trespassing. if you are denying the correctness of their measurements then they cannot force you out without a court order.

2) yes, you can and you should quickly because you only have 2 months to do so.

3) possible, but that is a separate case

4) yes, because theft is consummated upon taking

5) you can try, it's called malicious mischief.

May follow up question ako, sa pagnanakaw, naibalik kc yung celphone sa amin na.. marami na humawak so malabo na cguro ang finger prin.. pero marami nkakita na hawak nya yung cp at winagayway pa. Kitang kita ko rin yun kya nagalit ako kc ayaw isa uli.. pero nung bumalik ako galing brgy. naibalik daw ang cp at dun nakuha sa damuhan.. cguro hinagis nya dun. Anu makukuha ko pag kinasuhan ko xa ng direct taking of property? pagbayarin ko ba xa or ano nag parusa nun?

it is up to you if you will file theft charges or ask her to pay settlement. punishment for theft is dependent on value of property stolen, but note, your witnesses will have to testify and identify for sure that the phone she held was the one that is yours.

Atty, sobrang tagal na po ng kaso namin at nasa brgy pa lamang. Paano kami makapagfile ng counter case e di pa sila naghain ng case sa court dahil di pa tapos yung usapin sa brgy. march 27 nangyari at may na ngayon.. Ano gagawin namin?

allege a high value for the cellphone and file the case of theft directly with the prosecutor.

Hi atty,
I have a question, it is almost a month yung kaso nasa brgy parin. Ayaw ko kc mag file ng case immediately dahil hassle. Pwede ba kmi mag file at di na dadaan ng brgy khit yung kalaban nmin may pending case sa amin sa brgy? it is almost 2 months nasa brgy parin.

Hindi pla.. almost 2 months na nsa brgy parin. we need help. di ba mawalng bisa yung medico legal nmin dahil di pa kmi nagkontra demanda dahil wla pa nmang kaso na nkasampa sa korte?

as i said, you can file a charge of theft directly with the prosecutor. if for physical injuries, it should be more than 10 days to heal, otherwise, it's already too late to file it at the bgy.

Atty., may tanong po ako regarding the previous case posted above. Dahil ayaw ko ng gulo at nakaapekto sa work ko yung pag atend ng hearing, I decided na makipag ayos at nagkapirmahan para magbayad kami ng halagang 3k. Napagkasunduan namin na magbayad nung last June 15 ngunit tumanggi na sila at ayaw na nila ipagpatuloy yuing napag usapan. Ito po yung katanungan ko:

1.Yung incident happened last March, pag binigyan sila ng endorsement, is the case is still valid for physical injury?

2. Yung napagkasunduan namin, baliwala na ba yun dahil umayaw na sila?

2A: Halimbawa, pumayag na nman sila para ituloy ang napag usapan, at tatanggi kami magbayad, ok lang ba yun?

Nakasulat po at naka pirma kami lahat. pero nung magharap ulit.. Ayaw na daw nila ituloy. Question:

1. Pwede ba yun?
2. If pwede, pag bigyan sila ng endorsement, may bisa pa ba yung physical injury?
3. If hindi, at dahil umayaw sila, pwede ba na hindi na rin kami papayag magbayad?

what does this agreement say? argue that they cannot back out of the agreement because they already agreed to it. as long as you fulfilled your obligations in the agreement, they should not have a case against you.

you can use that as a defense.

In the agreement, we agreed to pay an amount of 3,000 pesos for physical injury but they refused to accept the time when we are ready to pay on the date we agreed. They said, "We don't need that money" , we need an endorsement for the case. So, we said, okay, let see in the court if you will receive an endorsement. Asawa ko kc yung kinasuhan nila, para di kmi ma hassle, at wla din nman kaming makuha sa kanila if magkasuhan kmi, so we agreed to pay na lng.

Hi aty... May question po aqregarding sa thread ko dito...about trespassing and physical injury:

1.Last June 2011 sumang-ayon kami sa usapin na magbigay na lng ng bayad sa nagreklamo kasi na hassle na rin aq sa work. Nagkapirmahan ngunit nung magkita sa brgy,binawi nila at humingi ng endorsement. Inantay namin yung kaso ngunit wla ng balita. Pagkaraan ng halos dalawang taon,bumalik sila sa brgy at hiningi na ituloy yung reklamo nila.. May saysay paba yun? Meron ba kaming action na gawin at e-request namin sa brgy na ibaliwala na yun dahil sa tagal na? Anong legal na tawag kung meron man. Pls give as an advised and legal action.
2. Wla bang expiration yung kaso na di binigyan ng endorsement at andun lng sa brgy?

Good morning po... Please help me naman po please.
My boyfriend's family has a compound residence and each of them have their own small house na inside that compound. When we decided to live together, pinaayos po namin yung sa kanya and almost ako po yung gumastos dahil ako ang bread-winner sa'min.After 4 years, we have 2 kids na. One night we had a very serious fight that made my boyfriend go out of our house. Upon knowing this, sapilitan po akong pinalayas ng mga in-laws ko together with my 2 small babies and they have our house locked. Every time that i'll go there to get some things for me and my babies, they are calling cops to have me dragged out and they said trespassing daw po ako...we possessed the house for several years na po and we even live on our own though we're still inside their compound,trespassing po bang matatawag ang pagpasok kong muli dun? what are my rights na dapat ko pong ipaglaban? kaklase po ng anak ng mother-in-law ko ung pulis na tinatawag nila palagi and though sinabi ko na sa kanya na 'di nya ako pwedeng pwersahing sumunod sa gusto nila, iginigiit po nilang, na-inform na daw ako ng miranda doctrine...wala naman po akong case at lalong walang warrant..kakaasar po ang pulis-pulisan na to.tulungan nyo po ako sa dapat kong gawin at ipaglaban dahil napakalaking kahihiyan na po ang ginagawa nila sa'kin..please po...thank you so much...

Atty. goodpm po may itatanong lang po sana ako .. yung kapatid ko po kase nabugbog ng 15na minorde edad sa school 14up age nung mga nambugbog.. nasugatan po ng grabe sa tenga kapatid ko at namamaga ang kamay dahil kinagat at puro sugat ang muka .. ano po ba ang dapat ikaso doon ?? slight physical injury lang po ba yun ? at makukulong po ba sila ?
