Gud pm po! ask ko po kung ano ang pwede naming gawin regarding the property na pinabili po ng uncle ko na nasa abroad. Ang binigyan po nya ng SPA ay yung sister nya from Pangasinan. Sinabi po kasi ng Tita namin na malinis daw po yung papeles ng rice land available sa Pangasinan for 1.2M at wala pong tenant. Yung uncle ko po nasa USA. Napaniwala po ng Tita ko yung Uncle namin at nagpadala po sya ng pera pambili. Nag execute na po ng conditional sale for the downpayment of 400k then yung absolute sale daw po ay after mabayaran ng full. Transaction date po ng conditional sale was May 1998. Ang nangyari po, alam po pala ng Tita namin na may tenant. At hindi mapaalis hanggang sa umabot na po sa DAR. Natuklasan po namin based from the bank accounts nung dumating po yung uncle namin 2 weeks ago na almost 700k na pala yung naibigay sa seller. Kami pa po ang lumalabas na nagbayad ng abogado para dun sa seller.

Isa pa po, yung Tita namin, di nya pinalagay sa conditional sale na sya ay representative lang ng Uncle namin. Kahit po sa adverse claim affidavit nya para sa anotation sa land title, name pa rin nya. Idinedeny nya ngayon po yung SPA na ibinigay sa kanya. Lumalabas pong sya na yung may ari ng lupa.

Sensya na po medyo mahaba po yung inquiry ko. Hingi po kami ng advise kung ano pwede gawin ng Uncle namin para mabalik yung pera.

your uncle has to show proof that he merely authorized her and gave her the money. he should send a demand letter, after which he can initiate a case for recovery.

he can also file an estafa case because you aunt abused his confidence.

Atty. thank you very much po. We really appreciate your advise. We'll tell my uncle to prepare a demand letter and also get his own lawyer for it. So far, we were able to get the dollar bank book in the name of our aunt. We were able to get also pertinent papers like a copy of Deed of Conditional Sale, acknowledgement receipts from the seller and the SPA from USA that was sent to her in 1998.
