Gud pm po atty.

May kasamahan po ang aking asawa sa trabaho na naka acquire at binili sa mababang halaga ang isang malaking hektarya ng agricultural land mula sa kanyang ninuno at na transfer sa pangalan niya ang titulo last 2003 pa lang. Inalok sa aking asawa ang isang portion ng land sa kanilang agreed amount at terms of payment na installament basis lang muna hanggat hindi pa mabigyan ng sariling titulo ang aking asawa in his name.
Ngaun po lumabas ang problema...Bago po naibenta sa aking asawa ang portion ng lupa ..hindi po namin akalain na hindi malinis ang original nilang titulo ..wherein nakasaad po dun na hindi pwedeng maibenta ang anomang portion ng lupa not until 10 years na ang acquisition ng nakabili at may nakasaad pa din po dun na batangas certified resident lang ang pwedeng makabili.
Since , hindi po kami residente ng batangas at wala pa pong 10 years ang transfer ng titulo from 2003 na nabili ng kasamahan ng husband ko sa kanyang ninuno,..wala din pong malinis na transfer sa pangalan ng husband ko sa kanyang binibiling portion ng lupa na mangyayari.
Nakapagbigay na po kami ng partial/installment payments sa kasamahan ng asawa ko dahil yun ang agreement nila at still demanding ng additionals. Ibig sabihin lang po na maka acquire lang po ng malinis na tittle ang asawa ko by 2013 pa since 2003 pa lang na acquire ng kasama ng husband ko ang titulo niya from his ninuno..Is it fair enough ho ba sa part namin na hindi na din muna kami magbigay sa kasama ng asawa ko since nag demand sila ng payments ? you can demand for refund because the sale was a nullity, or wait for 2013 so that it can be ratified.

Since nakapag partial payments na po kami sa lupa, at may building na po kami naitayo dun for a piggery business..medyo hindi na po kami makaatras but to wait for 2013 para sa ratification po ng tittle at okay na po ba yung hindi na muna kami mag additional ng payments sa kanila at matagal pa po ang kasiguruhan sa titulo para maging legal po ang transfer sa name ng husband ko even if mag demand sila ng karagdagang kabayaran for our good na din po .
Is it proper din po pa na mag continue kami ng operation dun salupa for our piggery business out of their demands for additional payments..and wait for any reaction on their part.

you will have to ask them to agree to those terms. negotiate with them. obviously they will not be happy that you will suspend payments.

What benefit do we get po sa "contract to sell"? Is it right to demand for this document...kasi may nagbigay po ng opinion sa amin ng ganitong agreement...na pwedeng proof na ang lupa ay to be sold pa by the year 2013..so that the owner could not force us to demand for additonal payments until such time na maayos na po ang titulo nila at ma transfer sa name ng husband ko ng malinis ang titulo..Please educate me on this matter..thank you po

if you take the position that you are not liable to pay, will you agree to convert part of your payments to rental payments? what will be the basis for your use of the land? note in a contract to sell, you do not become the owner unless you pay.

Gud day,

Atty, can u educate me on possible reasons behind why a "mother tittle" with a "note " stating that only 10 years after will the land or portions of the land be sold ? pressumably ,10 years after,last 2003, the son bought and acquired ownership of the land but the note and prohibiton to sell still exist on the certification of tittle being issued on the son meaning the procedure passes on every buyer .How will then the buyers be assured of a clean tittle .

i presume the property was acquired through the land reform program. if so, it can be transferred to immediate members of the family. once the period has expired, the annotation has no more effect, but you will need a clearance from the dAR to transfer.
