Arresto Menor
I have decided to resign from my work to attend to very important family matters. My employer wants me to pay her 40000 as damages in the pay back contract I signed on my first day of work. She wants to take my salary from April 6 to Aril 26 amounting to 7000. She also wants to take my fidelity bond of more or less 10000. Is it just???

40,000 as damages for resigning? why? did you just undergo training / seminar recently?

if said amount is part of you employment contract that in case you resign, you must pay it, then it is inappropriate considering that it is tantamount to involuntary servitude, BUT, if it is part of an agreement in exchange of training expenses the company incurred to train you and that part of the agreement that you must not resign within a certain period, then said penalty is valid, however, you may negotiate for a lower penalty in case you already served significant portion of the agreed period.

With regard to Fidelity bond, I dont think your employer is entitled to Fidelity Bond merely because you resigned, considering that Fidelity Bond is applicable only if you defraud your employer.
