hi atty,

please help me with my problem- i am a globe (landline & internet) subscriber since 2007. my landline is mostly for incoming calls and for emergency use only since i use the unlimited call promos of globe, smart & sun mobile phones. My land line phone is locked inside my room since it is only for business use and I am the only one who is using it.

Last April, i was shocked to see my billing for March 29, 2011 for a particular number in Manila (empire east dev't corp's number)which amounted to 4,474.47php and the said call lasted for 1,001 minutes which is equivalent to 16.68 hours call to an office with employees working from 8-5pm. The said call started at 11:06am so that means it ended at almost 4am in the next morning. That was really absurd because how will i stay long for 16 hours straight talking with someone over the phone. Besides, it's very impossible on my part since i will be the one paying it isn't it?

so, i immediately called the globe hotline and reported it to them- a customer service assistant told me that they will forward it to the technical dep't for checking- after around 2-3 days, somebody called from the technical dep't saying they are sorry but the phone call really came from my phone number so according to her, i have to pay it and since they saw that i was a subscriber for quite long already, she said that she will give me a consideration and request for a 25% deduction. I did not agree atty and i told her the circumstances that i really did not use that and i told her to check because maybe that's a technical problem- she said they have checked that it really came from my number and it's final na daw po. She said maybe the call was not properly turned off and i told her that how come because when u put down the receiver, the call automatically stops, besides the person on the other line will also put down the phone so how will the call go on for 1001 minutes. One thing more, the woman who called me said that basing on my past calls, she saw it that my long distance calls only lasted for some minutes and never an hour or more but then she's sorry because she can't do anything but request for a 25% reduction only if approved.

I insisted that i will not pay the whole amount and even offered to pay 25% of it even if i am very sure that i did not use that- the woman said that she will increase the reduction that she will offer to 50% if it will be approved by the management if i will accept it and that is final na naman ulit. I did not accept atty and that was the end of our talk. A while ago, i received an automated call from globe that they will cut off my line if i will not pay my bill till May 10.

Please help me attorney on what should i do. I will be waiting for your reply. Thank you very much and more power.

i recommend you make a letter or email to the company and write down all the circumstances. That way this isn't just all verbal.

would there be any reason why anyone would call empire east land? with the technology today, it's highly unlikely that there was a mistake.

they will probably cut off your service. i doubt if they will file a case against you for collection. you can keep talking to them to find some settlement.
