first time ko po bumili ng lupa dito sa manila nung 2003. sabi ng broker sa akin ay clean title daw ito and i believed them kasi matagal ko na kilala sila na mga brokers ng lupa dito sa amin. i was given a xerox of the title at kumpleto lahat ng mga papers pati mga bayarin sa BIR and Real Estate Tax. however, nung magkaliwaan na kami ng bayad, nakita ko sa original title na may nakalagay na Memorandum of Encumbrances stating: "Entry No. --- Liabilities: to creditors, heirs and other persons unlawfully deprived of participation in the estate of the deceased --- as extra-judicially settled for a period of two years pursuant to sec 4, rule 74 of the rules of court. date of instrument :--2003"
sabi ng broker, ok lang daw yun at pwede ko ipayanggal yung encumbrance clause after two years...since kapitbahay ko yung nagbenta ng lupa at yung mga brokers even up to now, tingin ko di naman nila ako lolokohin siguro at pwede ko pa silang habulin anytime.
naging busy ako kaya hanggang ngayon ay di ko pa napapatanggal yung encumbrance clause...how do i go about having this clause removed from the title?

moderator
the procedure is that a petition is filed in court where the property is located. there are lawyers who 'expedite' the process so i never handled one because i go by the book.

I have very same situation with this? What should we do to remove the encumbrances marks and get the new cleaned title in our name? Thanks.
