Hi
Me and my husband are not living together for almost 3 years,,,,he is not giving any financial support to my kids,,,,previously just a few days now I knew that he is working in a company and I know his bank account number kung san nya narereceive yung salary nya. pwede ko bang directly kunin sa bank nya yung sustento ng mga bata? We have two kids (7 years old at 3 years old) ayaw naman kasi nyang magbigay ng sustento,,kahit nakapagpadala na ako ng demand letter for financial support for once,wala syang response nun,, anong action ang pwede kong gawin? Thanks....

you can file a criminal complaint for economic abuse under RA 9262

if you can allege previous violent act, you can petition the court to issue Temporary Protection Order and his employer will be required to give you part of his salary.

Good Day po!
Need your help and advise..Natatakot po kasi ako. Simula Sept 14, 2010 ako po ay nag trabaho bilang seafarer.dahil sa sama ng loob ko sa asawa ko na pinalayas nya ko sa bahay nila at hindi na po kami nag sasama simula nung May 2009 at hindi niya po pinapahiram sa akin ang mga anak ko.Gumawa po sya ng kasulatan na kami ay separated, Dahil sa dinamdam ko po ang paghihiwalay namin,namuhay po akong mag isa. Nov. 2009 sa hindi inaasahang ako ay nakabuntis at nag kaanak, isinunod ko sa aking pangalan.Upang makapag ayos ng buhay at makaipon ako sana pang annulment,Pansamantala, hininto ko po ang komunikasyon at sustento sa wife ko at 2 anak ko dahil sa sama ng loob ko na hindi ko naman nakakasama ang aking mga anak at sa pag balik ko plano ko muling ayusin sila.Nov. 2010 nabalitaan ng wife ko na nagkaanak ako sa ibang babae habang ako ay nasa abroad.7 months natapos ko ang aking kontrata, nakauwi ako ng Pinas April 19,2011.May 14,2011 sinubukan ko aregluhan ang asawa ko at nakapag cooperate naman po siya thru fon.Pinadalhan ko siya ng aking naipon para sa knila ng mga anak ko sa account niya ng P15,000 bilang pag sisimula muli ng aking sustento sa kanila at maayos na relasyon.Ngunit huli na pala ng may mareceived ako na subpoena, at may case na complaint nya sa akin ay Abandonment in relation of RA 7610? Isinulat niya din doon ang pag kakaroon ko ng anak sa ibang babae. May laban po ba ako sa case niya? Ako po ba ay makukulong?Tinatakot niya ako na sasampahan nya ako at babaeng na nabuntis ko ng concubinage? May flight po ako sana ng June 15,2011 upang ipagpatuloy ang pagtatrabaho sa cruise ship. Handa naman po akong mag sustento sa kanila sa abot ng aking makakaya. Ngunit Iniintimidate ako ng wife ko sa telepono, gusto nya makuha ang lahat ng suweldo ko?Panu naman po ako at ang anak ko sa ibang babae na may rights din sa support ko? Please po kailangan ko po ang advise ninyo..Ako ay may hearing sa darating na June 2 at June 9, 2011. Kung makukulong po ako at mawawalan ng trabaho paano po ako makakapag support sa aking mga anak at makakaipon par amakapag file ng annulment against sa wife ko?

masyadong complicated yung problema mo. better consult a real lawyer who can give you legal advice considering that a subpoena/summon was already issued against you. at this stage of your predicament it is very imprudent to be seeking personal opinions. you have to consult a lawyer immediately so that you can prepare for your defense. di na ganyan ka simple ang problema mo.

ganito na lang gawin mo, kausapin mo asawa mo at kumbinsihin na iurong ang kaso kasi pag nakulong ka at nawalan ng trabaho pare pareho kayong mawawalan. maki usap ka na lang na su sustentuhan mo na lang sya sa abot ng iyong makakaya. di niya pwedeng kunin lahat ang sahod mo kasi kailangan mo rin mabuhay at pati na rin yung anak mo sa ibang babae. ang sustento naman e na aayon sa kakayahan ng magbibigay. di naman siguro pu pwede sasabihin ng korte na ibigay mo lahat sa kanya ang kita mo kasi may iba ka rin naman na obligasyon at karapatan tulad ng karapatan na mabuhay.

jeffrox, you should check with the bureau of immigration if a watchlist order was issued against you. if so, you will not be allowed to leave at the airport.

i can understand feeling bad and not wanting to support your wife, but your kids also? that's economic abuse.

work out a settlement. affidavit of desistance for allotment. even if you are able to leave, you might be facing a warrant of arrest when you return.

Kelan po ba dapat mag file ng affidavit of desistance for allotment ang wife ko? Before hearing on June 2 and June 9 or After June 2 or June 9? Maraming salamat po sa inyo.

Hi po, i realy need help pls....nabuntis po kase ako ng isang may asawa, nasa abroad po kami nun pareho at ng malapit nako manganak umuwi po ako d2 sa pinas at naiwan sya dun pareho po kami pinoy...ang anak ko po naka apelyido sa akin dahil hindi pa nauwi ang nakabuntis sa kin para pirmahan ang birth certificate nya...nung una po ay nagsusustento sya pero ngayon ay hindi na dahil may iba na syang babae..wala po syang trabaho ngayon dun sa abroad pero may apartment po sya d2 sa pinas na kumikita ng 40k monthly pero conjugal property po yun nila ng asawa nya, may dalawa po syang anak sa asawa nya na pareho ng may maayos na trabaho...tanong ko lang po meron po ba akong laban kung hahabulin ko ang sustento para sa anak ko kahit hindi pa naka apelyido sa kanya...thank you po at sana matulungan nyo ko...God Bless

annabelle, it will be difficult because you do not have proof of his filiation with the child.

one of the posters here also did not have a signed birth certificate, but the father admitted he was the father in his counter affidavit so the criminal case prospered.

e atty. puede po ba ako magpadala sa kanya ng demand letter of financial support? balak ko po kase magpadala sa kanya nun na i-aaddress ko sa bahay nila sa paranaque na ang makakatanggap yung dalawa nyang anak tapos ipapa scan ko po yung letter at ipapadala ko sa email nya para mabasa nya rin kase nga po nasa abroad sya...thank you po atty. i am realy desperate to seek help regarding my problem...

you may send a demand letter. make sure it is addressed just to him and no one else, and it is sent via registered mail. you should not care if someone decides to open it because you can become vulnerable for libel.

yes, you can send it also via email.

but again note, if you are later forced to take legal action, you will need to hurdle the issue of filiation.

good day.. i have a question po..i have 3yo son.im not married w/ d father of my son pro nkaapelyido sa knya ang anak nmin.dun kmi nkatira sa knila until recently we separated..kumuha ako srili kong aprtmnt at cnama ko anak ko..not them knowing our address..i want to receive financial support for my child,but he insisted..ibalik ko n lng daw dun sa knila t khit wag na ko mgbgay ng support..w/c i wont do ofcrse..i believe dat i have d right to have my son.all i need for him is a financial support..sbi ko wlang sustento, di nya mkikita anak nya..ok lng po ba un?? i demand for support and how mch po ba ang pwed ko hingin sa knya,since we also have eductional plan for our son to be paid quarterly,plus he's going to be enroled in a nursery sch..ano pwede kong gawin at sbhin pra mgbgay sya ng sustento.and if not ok lng b na di ko tlga pkita anak ko sa knya??i want to write a letter to be signed by him and den pa notaryo ko..but have no idea ano illgay ko..tnx so mch!!

the father has visitation rights, but if you refuse, he will have to take legal action to enforce it. it's not supposed to be traded for support.

i suppose he signed the birth certificate. if he refuses to provide support, your remedy is to file a case of economic abuse under RA 9262
