i would not advise you to immediately file for probation. only if you are convicted. otherwise you will have a criminal record.

attyLLL when po ibigay ung bail na 6k? before po ba ma receive ang warrant of arrest? or on that day? kc po nakakahiya po ung arestohin ka at anytime lalo na sa work area pa... mas lalo pong kawawa ung friend ko..

pwede pa po ba sya makakuha ng support from his husband if shes convicted and had probation?

if shes on probation can she still work?

does it reflect on the NBI if shes on probation?

find out which court the case was filed so you can immediately file bail.

she has to be found or pleads guilty if she will file for probation. yes, it will be in the nbi record.

attyLLL, ang mga gamit po (as conjugal property - appliances) nila ay kinuha po ng husband nya sa knilang conjugal house without the consent of her and bring it to the house of his parents.

diba po since nagfile ng adultery ung husband nya, still lahat po ng conjugal property ay on statusquo? anyone of them di pwede kumuha ng mga gamit without pre-nuptial agreement?.

can my bfriend file theft sa husband nya? eventhough ung husband nya nagfile ng adultery sa kanya?

umuwi sila both sa each parents house, wala na pong nakatira sa house nila. ang layo po ng house nila was in 1km from the house of my bfriend. at anytime pwede nilang bisitahin and to check.

ang reason po ng husband nya kaya nya kinuha ung appliances is for safety keeping and ginagamit daw niya. is it a good reason? or it is an excuse?

am here in the phil.. i am willing to humiliate him, di lng takutin sya,kung di patanggal sa trabaho, patanggalan ng visa at pauwiin dito ng walng wala!

Luvz: by your word, it appears like the alleged act of infidelity of your husband was committed abroad. If that is so, you cannot file a criminal case even for adultery here in the Phil. Pwede mo lang siya mapakulong sa Pinas kung ginawa nya sa Pinas ang krimen.

AttyLLL, emotionally stress na talaga friend ko.. can she file for VAWC nyan.. if so ano po ang kailangan rin po?..

ano po habol ng friend ko sa mga gamit nya? since it its their conjugal appliances and my rights naman ung friend ko don?

as per ng kapatid ng husband nya, wla na daw habol ung friend ko kasi po naka name na po lahat ng ownership ng mga appliances sa husband nya. tama po ba un?

she can file a criminal case just for effect and maybe have an agreement at the prosecutor's office. but my opinion is that it will not prosper. in fact you mentioned she wasn't even living at the house at that time.

she can also file a petition for a writ of replevin for return of the properties if she can show she has the better right to possess them.

what about ung payment sa pinarentahan nila na bahay, pwede rin b ung mahatian sya? kasi po ung husband niya ang kumuha ng lahat. ang problem kasi ayaw na nakipag usap ng husband niya sa kanya. kaya through court na lahat ng bgay.

attyLLL, may na rcv po na tex ung bfriend ko from her husband that "she forgiven her". hanggang ngaun po it is still on her celphone. pwede po ba un magamit as evidence don sa adultery case nya?.. may schedule na po sila sa pre-trial. pwede po b un ipakita sa judge as proof?. may nakasaad po kasi sa resolution "evidence to show that the respondent was already forgiven by the complainant".

it's possible, if it can be proven that she knew she was a homosexual before marrying you and that she concealed it in order to defraud you.

She knew she was a homosexual,and i even new that she is also, but i did not know that there is something going on behind my back with my wife and her homosexual friend. just discovered this few weeks ago and they still dont know that I know it, I just accidentally saw picture of them in our bed naked on her laptop when I open it one day cause mine got currupted and I had to finish some work so i decided to use her laptop. on the recently open documents i saw image from the laptop camera and saw lots of picture of them doing the deed. I was mad but still had control.That is why i set up a security camera on our bedroom to get more pure evidence before I proceed with the legal matter.

Alexm, if you knew that she was homosexual it could not be used as a ground for annulment. If you have prior knowledge of her homosexuality, then there could be no concealment.

I suggest that you go after that tibo with a civil case for damages.

If you can prove that your wife - not the other girl, is the tibo, you can file a petition for annulment. If you can prove that your wife was tibo during the celebration of your marriage and that she concealed that condition to you, you have a good chance for annulment.

I have read long ago that seemingly normal people but can maintain sexual affairs with people who are homosexuals are in reality also homosexuals. Parang sinasabi na bakla rin ang lalaking pumapatol sa bakla at tibo rin ang babaeng pumapatol sa tibo. I am not sure if that is just a theory of psychologists or if they have records to back that up. Better consult a noted psychologist on that.

if you knew she's a lesbian then that ground for annulment won't be work.

you are making yourself vulnerable to a charge of anti-voyeurism act with this security camera because it's secretly in the bedroom.

your clear legal remedy is legal separation based on her homosexuality. perhaps a better non-legal solution is to talk to your wife and figure out together how you want to move forward.
