Hi Atty,

I'm an OFW here in KSA. before i went here my husband and I got separated as he has a mistress. I hear that they already separated ways. for her, destroying my family

1. Can i file a case on my husband's mistress even if i'm here?

2. Can my parents file the case for me?

What evidence i need to pursue the case?

the viable case you can file, without including your husband, would be a civil case for damages based on interference with your family affairs.

you can execute a Special Power of Attorney to authorize your parents, but you will good evidence that proves that they had an illicit relationship.

Thank you Atty. I would like to read more about the case you've mentioned. Where i can exactly find the law/R.A/Code about that? I would really appreciate if you could give me a link on this.

Do i still need to provide evidences if she filed a case for my husband accusing my him that she was physically abused during their relationship?

that's art. 26 of the civil code. interference with family affairs.

if she files a physical abuse case against your husband, will you care to held defend him or he's on his own?
