helo po,

yong pinsan ko po sa call center nag work. tapos khpon text sya sakin dahil baka daw sila matangal dahil sa redundancy. ano ba itong redundancy? pareho ba po ang redundancy sa termination? ung sabi po ng kapitan sa barangay iba daw ang redundancy. tama po ba sya? ano po rason bakit tatangalin sa call center dahil sa redundancy?

redundancy, authorized cause of termination under the labor code.

meaning and ginagawa ng pinsan mo ay ginagawa rin ng iba niyang katrabaho. pwedeng marami sila na ang ginagawa ay halos pareho lang. example, 5 silang administrative assistant, if ever makita ng management na sobra ang 5 for an administrative assistant, they can terminate any of the 5.

eto ang nakalagay sa 283 of the Labor Code:

ART. 283. Closure of establishment and reduction of personnel. - The employer may also terminate the employment of any employee due to the installation of labor-saving devices, redundancy, retrenchment to prevent losses or the closing or cessation of operation of the establishment or undertaking unless the closing is for the purpose of circumventing the provisions of this Title, by serving a written notice on the workers and the Ministry of Labor and Employment at least one (1) month before the intended date thereof. In case of termination due to the installation of labor-saving devices or redundancy, the worker affected thereby shall be entitled to a separation pay equivalent to at least his one (1) month pay or to at least one (1) month pay for every year of service, whichever is higher. In case of retrenchment to prevent losses and in cases of closures or cessation of operations of establishment or undertaking not due to serious business losses or financial reverses, the separation pay shall be equivalent to one (1) month pay or at least one-half (1/2) month pay for every year of service, whichever is higher. A fraction of at least six (6) months shall be considered one (1) whole year.

tnx po sa reply.
may update sa issue. nagkausap na kami ng pinsan ko at nakwento nya detalye.

noong may 23 pinatawag siya ng mga kasamahan nya ng HR. mga 20 siguro sila. tapos sinabihan sila na yung client account is may planong lumipat ng ibang call center. sa ngayon, nagtratraining pa lang ng mga replacement agents sa bagong call center.

sabi sa letter is effective june 22 pa daw yung effectivity ng end ng employment nila sa companya.

pinaprocess sila ng clearance at kinuha na sa kanila yung access card at IDs nila. pero may sweldo pa sila hanggang june 22. tapos yung inofer na separation pay is makukuha after june 22 din.

pero tinawagan sila last friday (may 24) at pinapabalik sa duty. bigla daw kasi dumami ang customers nila. ang sabi ng HR noong pinatawag sila uli sa conference last friday is hindi na raw nila makukuha ang separation pay na prinomise sa kanila dahil marerehire na daw sila kung babalik sila. kung hindi daw sila babalik mateterminate sila dahil AWOL ang gagawin nila.

mga 10 yata silang pinapabalik tapos yung iba hindi na tinawagan...pwede bang pbalikin ang mga na-redundiate na emplyado ng ganon na lang? at yung pagkuha sa ID at access cards nila at pagpaprocess ng clearance noong May 23, di ba considered na yun na tinatapos na ng employer yung employment ng emplyado? bakit kailangan pang irecall ng employer yung mga naredundiate na employees?

bawal ba ang ginawa ng companya ng pinsan ko? kasi parang lugi sila.
