My boss is filing a qualified theft case against me... pls help

good evening po... the reason why i join this site po is because i want to seek some legal advice tungkol sa kinakaharap kong problema... it all started when i became an employee ng isang direct selling company sa starmall mandaluyong. actualy marami sa aking mga kasamahan ang nagsasabing hindi na raw kami makakaalis sa company na un yun kapag gusto na namin dahil gagawan kami ng boss namin ng issue para masira ang aming pagkatao... i dont listen to them at first until the day na mismong ako na ang ginawan ng boss ko ng issue...

hawak ko po ang kanyang tindahan dito sa rizal ako po bale ang store manager nila, kasama ko po ang 2 pang employees... a week ago nagbalak na akong magresign dahil nakakita ako ng bagong work (underpaid po kasi kami, walang overtime at walang mga extra pay and other privileges na dapat nakukuha namin bilang mga employees) pinigilan po ako ng boss ko at sinabing idedemanda nya ako dahil lalabagin ko ang kontrata na pinirmahan ko... ang pinirmahan ko po ay black documents lang at kya po ako pumirma dahil sa ayaw po niya akong pauwiin kung di ako pipirma.

hindi pa rin nya ako napigil umalis sa company at sa kasalukuyan ay may bago na akong work... akala ko ok na po ang lahat pero ang nakakagulat biglang tumawag ang dati kong boss at sinabing mayroon daw 50thou mahigit na nawawala sa akin during may term... nawawala daw yung mga o.r at ng magpa-update sila sa bangko nawawala daw po talaga....

ang nakakapagtaka paanong mawawala iyon eh sinabi po ng kasama ko na nadeposit na ang mga iyon di nga lamang po daw sa mismong araw na supposed na maideposit ang mga yon (dahil minsan po nagbabayad kami ng mga bill at rent ng aming office) may basehan po ba sila na kasuhan ako ng qualified theft kung yung gagamitin nilang evidence ay yung bank statement... how come po magtatally ang mga yun kung wala yung mga resibong magpapatunay na hindi nga po nadeposit iyon pls help me... thanks

if they do file a case against you, scrutinize their alleged facts closely. they have to provide evidence that what was lost existed in the first place and that you took them.

and natandaan ko po na before ako pinapasok nakasaad sa kontrata namin na magbabayad kami sa anumang mawawala sa aming tindahan during our term... pinapirma po niya ako ng katibayan noon bago akong magresign na if ever lumabas ang result ng inventory ko at mayroong nawawala ill be liable on it...pumirma naman po akokasi nga po clear ang conscience ko alam kong walang ninakaw ni walang nawawala sa grupo namin... kaso nagtxt ang boss ko po na nilagyan na nya ng amount ang pinirmahan kong note....ginawa nya yon bilang panakot po sa akin... in that case po magiging estafa na po diba ang ma-ifile nya at di qualified thief???kasi hindi ko po babayaran yon dahil wala naman akong kikukuha???
