Hello Atty,

Yung husband ko po nagkaanak sa isang babae which he claims he doesn't have a romantic relationship with.

Mag-2 yrs old na yung bata at ngayon ko lang din ito nalaman. He signed the birth cert. He was giving financial support until I came to know about it.So I refused to continue the support. My reason is, kung sa min nga ngkukulang pa yung sweldo niya tapos magbibigay pa siya sa iba. At kaya pala nagkukulang ay dahil dun. Housewife lang po ako at 2 na anak namin. Nag-aaral pa yung isa. Maliit lang din naman sinusweldo ng asawa ko. Hindi ko naman ma-take na magtipid kami, tipirin yung ibang pangangailangan ng mga anak ko tulad ng vaccines or send them to public school para lang makapagpadala siya sa anak niya sa labas.
Hindi rin po ginusto ng husband ko yung nangyari sa kanila. Actually, may parang emotional disorder po yung babae na nagwawala pag hindi pinapansin ng asawa ko kaya pinakisamahan na lang po niya. High school friend po kasi niya yun. Isang beses lang daw yung nangyari sa kanila. I chose to believe my husband kasi nababasa ko
rin naman yung mga texts and emails nung babae before (for the past years that they were friends) na begging for attention nga. Which means, di talaga siya pinapansin ng asawa ko. So the point is, siya naman ang may gustong magpabuntis eh. At mula't sapul alam niya pamilyado ang asawa ko pero kinu-kulit kulit pa rin niya. We think nga
na she desperately wanted na magka-anak sa husband ko tapos ngayon manggugulo siya for financial support.
Ngayon po nananakot yung babae. Magpapadala daw ng demand letter. Ano po ba pwede namin gawin? Ayaw po talaga namin magbigay ng kahit magkano dahil bukod nga sa hindi namin kaya, ayaw ng asawa ko talaga dun sa bata.
Ayoko rin po siya kasuhan ng monetary damages hanggat maaari. But if she pursues the child support case, I might be willing to. Another question is, when is the proper time to file this monetary damages against her?

Atty, May exemptions ba sa pagbibigay ng child support? Kung incapable po yung ama, ma-eexempt ba siya? Kasi yung babae mas capable naman na buhayin yung anak niya, may trabaho siya at may business pa yung family niya. Samantalang kami, nagkautang utang na nung nagkukulang na yung sweldo ng asawa ko. At yun nga yung nagbibigay siya dun dahil sa takot na manggulo yung babae. But since ngayon na alam ko na, wala na siyang guguluhin pa kaya ayaw na rin magbigay sa kanya ng asawa ko.

i would still recommend the father gives support or else be vulnerable to a criminal charge of ra 9262. i do not foresee the defense that his earnings is not enough for the legitimate family will prosper.

hindi po talaga sapat sweldo niya. tinutulungan lang kami ng ate niya para mapag-aral sa private yung panganay namin at binantaan po kami na ititigil ni ate lahat ng tulong niya pag nalaman na nagbibigay ang asawa ko ng support dun sa anak nito sa labas. At unfair naman po siguro kung ipa-public school ko yung anak ko makapag-suporta lang dun di po ba?
pano po ba pina-file yung monetary damages?

you can elect to use a small claims case. rules on sc.judiciary.gov.ph

again, if he does not give anything for the support of the child, it will be likely that a criminal case of economic abuse against him will prosper.

Good day,
First of all, maraming salamat sa mga gumawa ng website na ito. napakalaking tulong sa Pilipino.

Ang tanong ko po ay medyo related sa topic, single mom po ako, ung tatay po ng anak ko ay may anak na nung nagkaroon kami ng anak, after namin maghiwalay (2yrs old), bumalik sya dun sa kinakasama nya. nagkaroon ulit sila ng anak. 4 na po ang anak nila ngayon at kasal na sila. 8years old na po ung anak ko, nakapirma po sa birthcerticicate nya ung tatay. after namin maghiwalay nung 2yrs old pa lang ang bata, hindi na sya nagsustento, pero hindi naman po ako nagpupumilit humingi. ngayon po, sa work ko, hinihingan ako ng waiver para ako ang magclaim na dependent ko sya, ayaw po kasi akong bigyan ng opisina ng exemption sa tax dahil sa birth certificate nga po, may nakapirmang acknowledgement ang tatay. nakipagusap po ako sa tatay ng anak ko na kung pwde pirmahan nya ang waiver, para makaitipi ako ng konti sa tax, tutal naman ay hindi ako humihingi ng sustento. 4 na po ang anak nila at exempted na po sya sa tax, at wala din naman po syang kopya ng birthcertificate ng anak namin, sa madaling salita, kung ako ang maeexempt sa tax, wala pong magiging epekto yun sa kanya or sa kanila ng asawa nya. palagay ko po ayaw po ng tatay ng anak ko. kasi pinuntahan ko na po para sya ay pumirma, ang kelangan ko na lang po ay ID. na hindi nya binigay nung nagpapirma ako ng waiver, may tatlong bwan ko na po syang palaging kinokontak, isang kopya ng ID lang naman po nya ang hinihingi ko... hindi ko po sya hinihingan ng sustento.
hindi po sila naalarma. gusto ko na pong magfile ng kaso na applicable sa case namin mag-ina

have you tried saying that if he doesn't sign it, you'll ask for support? do you have a solo parent ID from DSWD? maybe your employer will accept that in lieu of this waiver.

Good day, AttyLLL, salamat po sa reply, sinabi ko po sa kanya na kung hindi sya pipirma, sustento ang hihingin ko, ang problema po, hindi naman din po makapagbigay, wla naman po akong magawa kahit puntahan ko sya at humingi ng sustento, nabanggit ko din po na pwde ako magfile ng complain o kaso laban sa knya dahil sa hindi pagsuporta pero hindi naman po sya naniniwala kasi hindi ko naman po tlga planong humingi ng suportang financial. ngayon po ay isang simpleng pirma at ID lang naman ang hinihingi ko, hindi naman nya magawan ng effort, parang tulong na lang po sa akin since hindi naman ako humihingi ng sustento, mabawasan lang naman po sana ang binabayaran ko sa tax. regarding solo parent ID, wala pa po ako nito, pero naitanong ko na din po HR na baka pwdeng ito na lang ang kunin ko instead na magpasa ng waiver, ang sbi ko sa HR< hindi daw un pwde dahil may iba daw po yung purpose, saka kahit mayroon daw po ako nito, irerequire pa din po nila ang waiver. salamat po ulit sa pagsagot, attyLLL.

a child allows you an additional P25,000 exemption from gross income. loosely translated, that will be about P5,000 additional income annually or additional P400 a month. there's no way to force him the waiver. you can send him a demand letter or actually file case of economic violence.

gud pm po, ako po ay may anak BABAE 1yr and 8mos na po. itatanong ko lang po sana kung anong hakbang ang pwd kong gawin para makahingi ng suportang pinansyal sa ama ng anak ko, hiwalay na po kami at may asawa na po sya ngaun at anak. hindi po kami ikinasal at 19 yrs old plang po ako ngaun. magtatrabaho plang po ang lalaki sa dubai kaya naisip ko na humingi ng suporta pro hindi maayos ang relasyon namin dahil matindi ang away namin kya hindi magbibgay un kung sakaling humingi man ako. ANO PO BA PWD KUNG GAWIN? SINO PO ANG MAHIHINGAN KO NG TULONG KUNG SAKALI?? PLS KAILANGAN KO PO TALAGA NG SAGOT NYO. THANKS AND GODBLESS

WALA po akong trabaho, at hindi po kayang suportahan ng mga magulang ko ang aking anak dahil may kapatid din po akong maliit pa at mga nag aaral sa kolehiyo. sana po masagot nyo ang aking mga katanungan. maraming salamat po ulit

atty. subrang nakakarelate akod dito, ung sa case ko same with us, may sakit po anak ko ngayon walang wala po talaga ako ngayon, humingi po ako ng tulong sa tatay ng bata pero sabi nya bakit pa daw ako manghihingi sa kanya may work nman daw ako.. kilangan po ng maintenance sa baga po ang baby ko need ko po support nya.
question:
pwd po ba ako sumugud sa tinitirhan nya para humingi ng suporta sa bata khit sa gamot man lang? may legal wife po sya,.

if he signed the birth certificate, i recommend you send a demand letter then file a complaint of economic violence at the prosecutor's office

good day po. may apo ako na 1 year old illegitimate pero apelyido ng tatay as he acknowledged the child and signed sa BC ng bata, ngayon po nasa qatar siya nag work, nagpadala siya 1 time then hindi na nagparamdam, he changed his contact number, does the child has the right to ask for financial support? and since hindi na ma contact ang father, saan po ba kami pwede ask ng help, we only know ung name ng agency niya dito sa manila,need your advice so badly, thank you.
