hello, just want to ask regarding my case. I actually got married way back 2007, and after a year and a half we separated but not legally though. Then this year actually, I was contacted by my ex-husband because he wants to file for an annulment but he wants to make sure that I will not make any appeal, because in this case he was advised by his legal counsel to talk to me so that the annulment case will be quicker. I told him that's fine with me and I dont care actually about the marriage. But we do have one kid and she stays with me and I'm the one who's supporting her but sometimes I contact her father to give me some help for financial needs, and I dont actually ask for a certain amount. During the time that I was contacted by my kid's father regarding the annulment I asked him what about the kid, the custody? He told me that I will have the custody and he will never get our kid from me. But on the sub-poena it was stated there, that in case that the marriage will be annulled, the child's custody is going to be with him. So I asked him that. He told me that the lawyer actually said that because it's needed on the petition. But just in case....meron po ba akong pedeng magawa pag sa huli na kunin na lng niya skin yung anak namin at gamitin niya yung sa annulment namin?

I recommend you file an appearance in the case and that you are opposing his petition as to the custody of the child.

good evening atty..my case is almost the same with her..if i may ask..if i file an appearance in the court,do i still need a lawyer or just myself?please help me.thanks

again, do you want to oppose the annulment? if not, then just let it take its course. if yes, then you should.

Good morning atty..i am also willing that our marriage will be annulled..though he was making grounds and allegations on me.One thing i would really oppose is the custody of my son that it will be never be with him. since birth of my son,it is already on my custody.The case he filed at me is that i am psychologically incapacitated.
