Sir/Madam,

Isa po akong OFW sa Qatar at kami po ng asawa ko ay hiwalay(not legal) na sa loob 3 taon. meron kami anak na babae sya po ay 3 taon na din. ang una ko po katanungan, my rights po ba ako na makuha ko ang anak ko pg umuwi ako ng pinas at mgbakasyon para makasama? un huli uwi ko last may 2011 ayaw ibigay sa akin asawa ko ang anak namn. ano po ba dapat ko gawin para makuha ko un rights ko sa bata na kahit makasama ko sya?
pangalawa po, nakatira sila sa bulacan, sinasabi ng hiwalay kong asawa na hindi pa enough ang 30000php na padala ko monthly which is hiwalay pa dun un pgpapaaral ng anak ko. humihingi ako ng katibayan mga resibo sa kanya pero wala sya maipakita. ang tanong ko po, mgkano po ba dapat ang ipadala ko para suportahan ko ang anak ko? sya pa ang my lakas manakot na issumbong nya ako sa immigration or kahit sa husgado mali pa daw ako at hindi enough ang binibigay ko, kung sa kali mgreklamo sya meron ba sya mahahabol sa akin gayung regular nman ako ngssuporta sa bata?
kung sakali po maaari ko bang makuha ang anak ko sa aking puder gayung wala naman trabaho ang babae at umaasa lang sa aking padala?
ang huling katanungan ko ay pwede na po ba ako mg file na annulment case sa asawa ko na babae kahit ayaw nya pumayag? natatakot kc sya na kpg ginawa ko un mawawalan sila ng sustento. ang nais ko sana pg ngfile ako ng annulment case isasama ko dun un kasunduan para sa anak ko. ang karapatan ng anak ko.
ako po ay humihingi sa inyo ng tulong upang malinawan ang aking pgiisip.

it will be very difficult to try to get the child. for one, are you willing to give up your work and stay here? worse, the law states that no child below 7 shall be separated from the mother unless there are very good reasons such as the child is in danger.

P30,000.00 is a very substantial amount, but she actually has property rights to half of your earnings, though it is not a crime not to give your entire salary.

atty, salamat po sa reply nyo. tungkol po sa aking sustento sa bata, pwede po ba i consider ang binabayaran ko at gastusin ko dito sa abroad para ma compute ang tamang padala sa bata or kahit ano pang gastos o bayarin ko dito kylangan ako mgpadala ng kalahati ng sahod ko?
pwede ko po ba gawing grounds sa annulment un muntikan nya na ako saksakin? ipakulong at baligtarin ang totoong ngyari? ipa barangay at mghingi ng malaking pera?

You can use those instances to prove that she is psychologically incapacitated. Yun yung tamang ground.

moderator
if you keep your evidence that you are sending P30,000 regularly then I think you'll be ok. only a psychologist can truly diagnose psycho incapacity.
