Hello Atty.!
Isa po akong member ng aming Association dito sa Palmera Heights. Nangungupahan po ako dito na mahigit na sa apat na taon. Yung kasalukuyang By-Laws namin, basta daw po member, puwedeng kumandidato bilang Board of Directors. Ngayon po kasi, may ginawang revised na ang present Board. Hindi na daw puwedeng humawak ng anumang posisyon ang mga lesee sa Association. Pero, patuloy kaming sinisingil ng monthly dues. Bakit po ganun? Ano po ba ang tamang hakbang sa pagbabago ng By-Laws? Kasi ang ginawa po nila, nag meeting ang Board, inaayos nila ang bawat section ng By-Laws tapos pinirmahan na nila. Last Sunday, may General Meeting kami. Ang akala ko, paguusapan ang bawat section... hindi pala. Pipirma na lang pala kami. Ano po ba ang habol ko para hindi naman ipagkait ang privelage ko para kumandidato? Ang paliwanag daw kasi nila is, anytime daw, puwede kaming umalis kasi daw, lesee lang kami. Ano po ang gagawin ko? Salamat!

see ra 9904. the owner of your leased premises has to issue you a written authorization to exercise his rights, but it is indeed possible for a lessee to participate in the homeowner's assoc

Good day po, gusto ko lang po sana magtanong tungkol sa karapatan ng umuupa. kasi po ay umuupa po kami ng mga kaibigan ko, yung apartment po ay may dalawang pinto (o may katabing apartment po kami) at iisa lang po kami ng gate, may ikutan po yung bahay papunta sa likod pero po ang daan nila ay sa may side namin o papasok po doon sa loob ng bahay nila, eto po yung publema namin meron po silang mga aso na nakakagat sa kaibigan ko po bali nagbabayad naman po sila pero 2months po bago maibigay unang bayad, eh dahil bago po kami eh kailangan po namin makisama, pinabayaan po namin ang masaklap lang po ay hindi po nila tintali o wala pong kulungan yung mga aso, kaya po nakakalabas po sa bahay nila na minsan ay sinusugod parin po kami nung mga aso po nila nakailangan pa po namin sumigaw na nakalabas aso sila o kailangan pa po namin sumilip bago lumabas ng bahay, inilapit na din po namin po sa tatay nung may-ari pero wala pa din pong ginagawa(yung may-ari po kasi nasa ibang bansa), at yung labahan po namin ay nasa gilid po namin na ikotan po papunta sa likod ng bahay po nila, naglagay po kami ng harang doon para hindi po makadaan yung mga aso nila kapag naglalaba po kami, pero po pinatangal po ng tatay ng may-ari kasi ayaw daw po ng may-ari, bawal po ba kaming magreklamo lalo na po kung kaligtasan na po namin ang nakasalalay?? at yung kapitbahay po namin na lagi pong napapabrgy at nanakot po ay hindi po ba namin sila pwede ireklamo sa brgy kahit dun po sa aso nilang pagalagala sa loob po ng bakuran?? at doon po sa pananakot nila dati po siyang militar at kay honasan po siya nagtratrabaho dati at yung asawa daw po niya ay kay councilor(ng marikina) daw po nagtratrabaho.. anu po bang dapat namin gawin?sana po ay matulungan nyo po kami.. salamat po

Magandang araw po Attorney. Ask ko lang po sino po ba dapat ang mag provide ng kuntador ng kuryente? yung nangungupahan po ba o nag papaupa? kasi naka submeter po kami ayaw pakabitan may ari ng kuntador kasi may utang dati sa meralco yung last tenant. eh problema po namin mali sila mag compute at mahal. so gusto po namin pakabit ng sariling kuntador. pag ginawa po namin yun at binayaran yung utang pwede po ba namin ibawas sa renta yung nagastos namin? salamat po

I got the idea of writing to you due to the situation we are in right now. My family and I just moved into this house, almost 2 months ago. Before we move in, we clarified everything that needs to be clarified with the house owner. The house is in a semi commercial place, and the house owner told us before hand that it will be fine if we will use the place for ANY business, all we have to do is to add 500 pesos to our actual monthly fee. We were happy and contented when our landlord said that ANY business will be fine for as long as it will not be illegal. We pointed out to the landlady that since the place is a semi commercial area, we will be open for any kind of business. We told her that sooner, we will buy a pure breed dog for breeding since my husband is an animal behaviorist and specializes in dog training, and she said, IT's FINE. Came a time when we bought a 1 yr old belgian malinois, she reacted and told us that the dog is too big, scary and all negative things about the dog. The dog is not doing anything to her, it's on a leash and trained. She said that she THOUGHT, we will only buy small breed of dogs. And now came a point that she sent me a message (through txt) asking us to use our advance and deposit and vacate the place, she said that they will be using the house. I replied to her and told her that we will vacate the place in our most convenient time and not because we are pressured. Since then, she and her relatives became arrogant to us.

In this situation, what rights do we have as a tenant, given the fact the we just moved in not too long ago and we have signed and agreed to a contract for a year? Do we have a right to demand any notice from the landlady, and if so, how many months should it be? During the notice period, do we have to pay the actual rental fee?

hi, may nangungupahan sa amin n dating pulis at lagi nyang sinasabi na wala kaming karapatan na paalisin sila sa bahay dahil may anak sya na 3months at wala pa silang malilipatan. Nagbayad sila ng 1 1/2 months na para dapat ay 1month advance at 1 month deposit. ginawa nyang hulugan ang pagbayad sa amin at pati ilaw at tubig hindi pa din nya binabayan. 2 months na ang mga bills nila pero lagi nyang dahilan na wala pa silang pera. Lagi bang dapat masunod ang Right of Lesse na dapat 3 consecutive months na wala syang bayad para lang ma-evict sa paupahan namin...? thanks and God bless Smile

we were renting the place for more than 6 years and nagtaas na sya once at balak na namang magtaas ngayon, medyo hindi na kakayanin ng budget at pakikiusapan naming iretain na lang ung rental fee kung pupuwede, pero kung hindi hindi sila papayag, we plan to continue to rent the place with the previous fee until such time na makakita kami ng place, would that be possible? thanks for the advice

hi, gusto ko lang malaman kung nasa batas na dapat magbigay ng palugit yung mayari ng bahay for 90 days bago paalisin..at kung pwedeng within that period wag na muna kaming magbayad ng rent. Yun po bang nakalagay sa RA 9341 which states that the lessor should give a notice of 3 months in advance before magpaalis ng tenant.

Should we also pay for that 3 month period or pwedeng hindi na..para makaipon kami ng pang deposit sa lilipatan namin? Besides, our landlord never issue an official receipt issued by the BIR within the period of our stay prior sa pagpapaalis nya. Please reply asap po. Thanks

gud am sir, very critical situation po.meron ako tenant na one month pa lang nakatira.madami na naviolate na rules sa room.very unsecure na ang bahay namin.umaalis sya sa madaling araw di naglolock ng pinto.tatay nya pinaalis ko kasi dalawa lang allowed.lola at apo na lang ang magkasama.yung tatay may history na ng bad behavior sa amin di ko nalaman.takot kami baka bigla kami pasukin kasi yung anak nya nasa amin pa nakatira.kwarto lang ang pagitan namin at manipis pa na plywood.pina aalis ko na sila.nagbigay ako ng 2 weeks notice.ayaw umalis.inalisan ko na ng ilaw at tubig. ako pa daw ang idedemanda. gabi gabi kami di makatulog.kaya po ba ng barangay na paalisin sila?ano po dapat gawin ng barangay?sabi ng pulis wag daw ipadlok kasi coercion yun.kaya di ginawa ng barangay.we dont feel safe anymore.pls help.
