Pls I need help. At present, ako po ay isang Computer Instructor sa xxxxxxxal College of Paranaque na matatagpuan sa Brgy. Saxxxxxx Just accross the Evxxxxx, malapit po sa BIR Region 512.. Last summer po, binigyan ako ng aking Dean ng teaching load sa mga nursing students. Tinapos ko po yun at nakuha ko ang aking salaries ng maayos until ng ako po ay magpapa clearance na para makuha ko ang last salary ko for summer, ang college president po na si Mr. xxx ay nagtanong sa akin if ilan ang student ko. sinagot ko po siya na 12 lang p kasi yun lang po yung mga nag enroll sa subject na Nursing Informatics, sinabi pa niya sa akin, hindi po ba daw lugi ang school kasi 12 nga lang yung student ko. ang ginawa po niya, he instructed the Vice President for Finance na si Mrs. Pamexxxxrial to tell me na dapat kong ibalik ang 50% ng sweldo ko kasi daw po 12 nga lang ang students. Pero wala naman po akong pinipirmahan na memorandum na para maging kumpleto ang bayad sa sweldo namin dapat 15 or more ang students namin. Tama po ba na ibalik ang sweldo ko na nakuha ko na. ang Pagkakaalam ko p, hindi ka pwede mag implement ng Law na retor active ang bisa at kasama diyan ang memorandum pero yun po ang ginagawa ng College President namin ngayon. kinakaltas niya sa sweldo namin ng PhP700 kada sahod daw para maibalik namin ang 5,400 na sweldo namin. sinimulan na po niyang gawin ito sa aming mga faculty niya na nagturo ng summer. Pls help me naman po. pwede ninyo po ba na tulungan na rin kami na mai akyat sa National Labor Relations Commission ang problemang ito kasi isa po itong paglabag sa labor code sa pagkakaalam ko. Tama po ba ako. Sana po masagot ninyo ang aking mga katanungan.

ART. 113. Wage deduction. - No employer, in his own behalf or in behalf of any person, shall make any deduction from the wages of his employees, except: chanroblesvirtuallawlibrary

(a) In cases where the worker is insured with his consent by the employer, and the deduction is to recompense the employer for the amount paid by him as premium on the insurance;

(b) For union dues, in cases where the right of the worker or his union to check-off has been recognized by the employer or authorized in writing by the individual worker concerned; and

(c) In cases where the employer is authorized by law or regulations issued by the Secretary of Labor and Employment.

your remedy is to file a complaint at nlrc or at dole. you just have to go there and fill up a form

regarding po sa problem ko, bgla po ako dideductan ng 2000k w/out written authorization and ung SSS po namin wala pa pong laman. 7 months na po ako ngwowork sa agency namin

what is the basis for the deduction? you can file a complaint at the SSS

Nagwowork po kasi ako sa Airline then my nacomment po ako sa system na mali then I received a notice to explain report last June regarding about dun sa mistake na nagawa ko and I have to explain my part in order for me not to pay 9,000. Naitama ko naman po siya agad then pinasa ko agad ung notice to explain ko the day I received the paper, then I asked them sabi nila ok na daw. Then nung month of July they asked me again to pass the same notice to explain report because nawawala daw ung pinasa ko. Then this month of August they told me na kakaltasan na ako ng 9,000 because nakaltas na daw ni Airline Company sa kanila ung 9K so nagulat po ako kala ko ok na noon tapos I asked the Airline management they told me na my agency didn't pass my report kahit na 2x ako nagpasa no advised from them na ganun na nangyari. The airline just told me na aayusin nila or idedebit memo na lang just incase. I asked my agency they told me na may "pipirmahan" naman ako bago ideduct if ever di maaus pero di nila ko tinutulungan regarding my problem. Then this sahod po nagulat ako kinaltasan ako ng 2k w/out informing me then I'm asking where is the pay slip then they told me I have to wait eh buong month ng October po wala pa sila binibigay na pay slip sa akin. Hindi rin po nila maexplain agad kung bakit ako nakaltasan.

you can file a letter to your employer to question the deduction then you can file a complaint at nlrc for illegal deduction
