We have these two employees from a branch, to whom we entrusted to run the branch as manager and the other, as the cashier. In connivance, both stole money from their daily sales which never reflected to their daily sales report (compass). undeposited daily sales accumulated until a sum of Php 410k. We released a memorandum requesting for their explanations as to why there were undeposited sales. an audit conducted by our finance department confirmed and validated the undeposited sales, regarded as losses. both employees gave their explanations admitting to have stole from the branch and offered/authorize us to deduct from their salaries their amount stolen. can we file Qualified theft or estafa?

moderator
i would consider it more like estafa trough abuse of confidence, but the common practice is to charge them with both and let the prosecutor decide which one to file in court.

Nag work po ako dati sa pawnshop for 5 yrs. Then nung year 2008 nakagawa po ako ng pagkakamali. pina blotter po ako ng boss ko ng qualified theft. pinag confess po nila ako kahit na wala po akong lawyer that time. napagkasunduan po namin na bayaran ko na lang ang nakuha kong pera. naibigay po namin ang kalahati pero may balance pa po ako sa kanila hanggang ngayon. ipinahawak ko na po muna sa kanila ang isang titulo ng lupa namin habang hindi ko pa nababayaran ang balance ko. hindi ko po alam kung nakapag file po sila ng qualified theft sa akin dahil wala naman po akong natatanggap na sub poena. wala rin po akong warrant of arrest. sabi po kasi nila dati itutuloy nila ang demanda kung hindi ko mabayaran lahat. ngayon po gusto ko po sanang mag work sa abroad para mabayaran at makuha na namin ang titulo ng lupa namin sa dati kong boss. makakakuha po ba ako ng nbi/police clearance? baka po kasi may hit ang pangalan ko kaya natatakot po akong kumuha. at pano po ba malalaman kung blacklisted akong umalis ng pilipinas. Attorney sana po masagot nyo po ang mga katanungan ko. thank you po.

the only way to find out is to actually apply for your police and nbi clearance. if there's a hit. issue an authorization letter and let someone else get it for you. you should have received notices if they filed a case and you did not change address.
