it can be withdrawn but the employee has a right to claim damages

Hi AttyLLL,

Recently I retracted a signed job offer (i.e. employment contract) three (3) weeks prior to my start date.

When I retracted the contract, my understanding was that I might be liable to pay the 130,000 pesos bond indicated in the contract. This was my understanding of the contract, but a part of me also says that I am not yet their employee so I am not sure if I should pay this amount.

However, the employer upon learning of my withdrawal sent me a letter indicating their claim demand of 2.6 Million pesos, OR I honor the contract. And if they will file the case to court they will seek a claim of 8Million pesos, accordingly.

For me, the letter sent to me has the tone of harassment. Considering that these claims are overly stated and not stipulated in the contract.

To be honest, I retracted the job offer because after thorough thinking I realized that it is best for me to remain with my current employer and no longer resign. The offer wasn't really that good either.

Appreciate if you can give me advise on this matter. Thank you.

My only concern is, I am willing to settle the bond (130K) if that is really necessary. But the claim of 2.6M is just something that I can't. I am just an employee with average salary.

look up employment bond in the forum. i wouldn't even advise you to pay 130k unless they can substantiate their losses.
