Good day po atty., ask ko lang po sana if legal ba ang ginagawa ng mga BI officer na pag oofload sa mga pinoy na may tourist visa sa aligasyon lang na BAKA involved sila sa human trafficking?

Last june my sister was being offloaded from her flight to macau, she has her visit visa and invitation from her fiance, completely documented. Ang rason po ng BI officer at first was...hindi daw valid ang Visa na pinadala ng fiance nya...nang hingan po sila ng kapatid ko ng statement about sa dispute nila sa visa nya telling them that she is going to inform her fiance and macau government nabago na po ang grounds nila sa kapatid ko, OK naman daw po ang Visa na dala ng kapatid ko pero ang problema naman daw po ay may dapat daw po isettle na penalty ang kapatid ko sa POEA dahil previously she went to dubai as visit visa and later returned as working visa, na dapat daw po magbayad sya sa POEA na ipinagtataka po nya at sinabi nya na kung meron sya dapat bayaran sana nalaman na nya dahil last he went back to dubai sa POEA sya kumuha ng OEC. Pero ipilit po ng tatlong BI officer na nag interview sa kanya na offload sya dahil may penalty sya na dapat isettle sa POEA at ipinipilit po na kaya lang sya pupunta sa macau ay para maghanap ng trabaho, na bakit daw po sya gagastusan ng boyriend nya sa macau eh fiance pa lang naman daw po sya.

Bakit po ganun? completo naman po ang documents? LEGAL, her visa was confirmed and verified by Macau Government na may sponsor sya pagdating nya sa Macau, besides hindi po nya first time pupunta ng Macau, pang apat na beses na nya sana pero hindi naman sya naghahanap ng trabaho dun, visit lang talaga ang intensyon nya.

anu po ang pwede ibalik sa mga BI officer na ganito? Hindi po ba sila pwede hingan ng formal report which includes the reason why they offloaded the person? para if mapatunayan naman na mali sila eh pwede sila naman ang bigyan ng penalty?

Talo po ang kaso mga inooffload nila... nasayang ang ticket, ang pagod at pera na ginastos din papunta pa lang ng airport, at ganun din ang pinang ayos ng visa na nanggaing sa macau? Pwede po kaya na irefund nila yun sa tao kung sila naman talaga ang mali.

Parang napakalaking unfairness po kasi, discretion nila lahat ang decision, pag ayaw nila, ayaw na nila, ganun na lang po ba yun? Paano naman po yun inoffload na tao? Wala po ba pwede gawin na legal actions dito?

you can file admin charges against the bi officer, or a civil case for damages for abuse of right.
