hi.. anybody who can help us regarding our problems with this illegitimate son of my husband daw?? my husband didnt claimed that he is the father of the child.ipinipilit ng babae ng anak daw ng husband ko yung 8yrs old nyang son. and she is asking for financial assistance, dahil ayaw na din namin ng gulo binibigyan namin ang bata kapag meron, hindi rin naman ganun kaganda ang buhay namin.may tatlo din kaming anak na nag-aaral.last time nagbigay kami ng pera sabi nya last na daw, and now eto na naman nagdedemand na naman sya kasi may sakit daw ang anak nya.last na daw maipagamot lang daw ang anak nya hindi na sya manggugulo.. ano po bang agreement ang pwede kong gawin na huling beses na ito na magbibigay kami sakanya..gusto kong maging legal ang usapan namin kaya gusto kong magkaroon kami ng agreement na we will support the medical assistance ng bata pagkatapos nun ay wala na at kapag nanggulo pa sya ay idedemanda na namin sya.. please help.. thanks and good day!

there can be no agreement with regard to support. it cannot be waived. did your husband sign the birth certificate? although, the giving of support can be used as evidence that he acknowledges the child.

no.. he did not signed the birth certificate.. naaawa lang kami sa bata kaya nagbibigay kami kapag nagkakasakit. at sabi ng husband ko hinding hindi nya kikilalanin na anak yung bata. ano po maganda gawin? pwede ba nyang kasuhan ang asawa ko kapag hindi na nagbigay ng support? although sabi naman nya last na daw kapag naipagamot namin yung anak nya.kaya gusto ko sana magkaroon kami ng agreement na hindi na sya magdedemand ng kahit ano pagkatapos namin maipagamot yung anak nya..

moderator
you can have an agreement, and she may respect it and never bother you again. but legally, the child would still be entitled to support if it can be proven that your husband is the father.

hi! good day po. my problem po kasi kami ng bf ko. kasal n po sya 11yrs n. may anak na po sila 2 lalaki. ang una po ay 11yrs old n yun panganay. nag plano po kasi sya kunin un asawa nya s dubai para makatulong po sa financial na pangangailangan nila.nagpagawa po ang bf ko ng fake n kasal nila..nkalagay doon nag pakasal sila yr 2000 pero po ang dukomento ay original.gawa po iyon ng rehitradong lawyer,wala po sya on the spot sa ngyari kasalan. ang pirma din po ng bf ko doon ay hindi sa knya... pero po my witness, pangalan ng magulang nila n nkapirma din pati ang mayor ng munisipyo.ngayun ang dokumentong gnawa ng lawyer marriage contract n original ang prinesent nila sa immigration pra mka alis as spouse visa papuntang dubai.nka alis po un babae..papuntang dubai.. dun po nabuo ang kanilang pangalawa. na ngaun po 1 yr old na. wla po nhanap n trabho un babae kya umuwi n lang ng pinas oct2010...ayaw din po kasi nun magbanat ng buto.wala n po un babae sa dubai noon magkakilala kami ng bf ko.. nun umuwi po ako ng pinas april2011. kumuha ako ng cenomar ng bf ko.ngaun taon lang po ng may2011.nkalagay po dun n married sya dun sa babae.. at nkalagay na enrolled march 30 2011. ano po ibigsabhin non? may chance po ba na mpa annul un kasal nila legally? tsaka po ano po maaari mngyari kung sakaling ganito po ang sitwasyon ng marriage contract nila?? pls po paresponse sa sitwasyon nmin ng bf ko. nag aalala po kasi ko kung ano maaring mngyari kpag nilaban nya ang annulment doon sa babae na sa katunayan po nag pagawa po sila ngaun ng kasunduan n wlang ng pakielaman at pyag sa process ng annul.. n pirmado din po ng atty. pls po pakisagot. salamat.

queencie, the court will probably order a dna test. if your husband is not the father, you can demand that what was given as support be returned.

liza, the presumption is that the marriage is valid until it is proven in court that it was a mere fabrication. he can indeed file a petition to annul the marriage especially if he was in dubai at the time of the supposed marriage.
