i had a relationship with a married man. after breaking up with him i found out that i was pregnant. i had a lot of arguments with him including his wife.

the wife threatened me that she will sue me for making threats against them. they also made threats against me.

i was asking him for financial support for my pregnancy. but he refused to give me any help. once i had a chance to talk to him. he made me believe that he was going to give me the help i needed. during that meeting i agreed to be intimate with him again since i thought it will make him reasonable to my needs. weeks after that meeting i never received any kind of support from him.

he told me he will post our "personal" videos online if i keep on contacting him.

5 months into my pregnancy. i suffered a miscarriage.

attorney.

can they file a harassment case against me?

and second what case can i file against him?

do those videos really exist? did you know that the video was being taken?

if you did not communicate anymore after the miscarriage, then i don't foresee that any harassment case will prosper. you can file a case of threats against him if you can prove your allegation. if he does upload the videos then he can be liable for anti voyeurism law.

Thanks atty for your input.

But aside from the threats that he made against me regarding the videos. If I file charges against him under the provisions of the republic act 9262, in your opinion sir will it prosper?

I have been in a very bad financial state due to the medical expenses during my pregnancy. Emotionally and physically I suffered a lot. And the trauma of losing my baby is a burden that hangs over me. Is this enough to file a case against him? I am more interested of filing criminal charges against him.

you would have to show that he deliberately inflicted physical and psychological violence. that can be very difficult if you do not have evidence.

Atty, what kind of evidences must a present to prove my case?

Denying me financial support for medical reasons is not enough to prove that he deliberately caused me harm?

if a man denies that he is the father, he does not have to provide support to a pregnant mother. the mother would then have to file a petition for provisional support while pregnant.

i do not believe a criminal case will prosper. you can try to claim your medical expenses from him through a collection case, but you would have to at least prove that you had a relationship.

Now I am not really interested in making a refund of my medical expenses.

I have proof that we were engaged in a relationship during the conception of my baby. Medical reports/ultrasound showing the progress of my then pregnancy.

based on your narration, i'm afraid my opinion is that a collection case is already iffy, and a criminal case will be unlikely to prosper. he may be a jerk, but that doesn't necessarily make him liable.
