Good eve attorney. nag-post na ako dito before and would like to seek advice again. i am here in saudi arabia. we already have misunderstandings ng ex wife ko dati pa. yan na po ang gusto ko itawag sa kanya. at lalo pong lumala nung umalis ako dahil andami ko pong nababalitaan na utang niya at kung anuano pang mismangement sa perang pinapadala ko. kaya po hindi ko na pinadala sa kanya. noon May ay umalis sya ay sinama ang dalawang anak namin na 3 y/o and 1 y/o. yung 3 anak namin na nag aaral ay naiwan. pero nalaman ko po na balak niya din kunin pero kinausap ko ang mga bata na wag sumama. napag-alaman ko po na idedemanda daw ako. ang mga tanong ko po ay:

1. anong kaso ang pwede niyang isampa sa akin?
2. pwede ko ba sya kasuhan din kung sakali ng abadonement?
3. pwede ko ba yun maging reason for legal separation?
4. meron ba siya karapatan na kunin ang 3 anak ko na natira dahil inaasikaso daw ang transfer ng mga ito sa school sa probinsya? sinabi kasi ng school na wala daw silang magagawa kung kunin daw ang mga bata ng nanay nila

sana po ay matulungan niyo ako. gusto ko na po sana umuwi para harapin anglahat ng ito pero nasa Saudi po ako at mahirap ang mga patakaran dito sa pag uwi. maraming salamat po.

Yes atty still sending. But not directly to her. nakikipadala po ako sa bank account ng kakilala ko. at ang mother ko po ang tumatanggap nito for budgeting para sa mga anak ko na natira sa bahay. hindi na po kasi macontact ang nanay ng mga bata. ilang beses na nila tinatawagan at tinitext but no answer.

1) probably RA 9262
2-3, abandonment can be a valid reason for legal separation
4) as their mother, she can indeed get the children

thank you for your reply atty.

1. how hard should her evidence be for this to prosper just in case she files?

2/3. do you think it will prosper if i file this against her? based on the situation i gave is it enough? or meron po ba dapat minimum number of months/years para masabi na inabandona niya ang mga bata?

4. if this will prosper, that means ba na i get full custody of the children? wala rin naman kasi siyang trabaho so hindi niya masusuntentuhan ang mga anak namin panigurado.

moderator
with regard to custody, i would side with the parent who is here.

if you can prove that you are sending remittances then you should have a good defense. there is a presumption of abandonment after 6 months for criminal purposes.

Thank you for your reply atty. another question attorney, yung 3 kids na naiwan sa bahay ay ages 7, 10, 13. from what I know, pwede na sila sumama sa kung sinong parent ang pipiliin nila. tama po ba? age 7 above po di ba? i also know na hindi rin pwede through proxy like my mother ang legal custody sa mga bata.

my question is, if kinuha ng ex wife ko ang 3 kids ko papayagan ba sila ng batas na mag-stay sa mama ko kasi ages 7 above naman sila at pwede sila mamili. kahit na wala naman ako sa Pilipinas as their father?

i will say that it is possible. the choice of the children is not binding but will be considered by the court.
