I need your legal advice po. medyo long story so please bear with me. I work in a call center po pala. It was last may19 ng pumasok ako sa office pero brownout kaya elevator..direcho po ako sa clinic loated sa 2nd floor at dun ko din tinawagan ang manager ko na ndi ko kaya umakyat sa 7th floor dahil maselan at 7th month ako buntis.. ok naman ang sagot nya.. after 10mins ay dumating ang dalawang supervisor at sabi ng isa "tara umakyat ka muna at maglogin",, nakatanggi ako sa unang pagkakataon at cnbi ko na iinom muna ako gamot.. pero ng makaalis sila ay humiga na ako sa clinic.. after 15mins ule bumalik supervisor ko at ng marinig ko sya ng tanungin ang nurse kung nasaan ako eh napabangon ako at sakto ko nkita reaksyon nya muka nya ng sabihin "gano katagal yan, isang oras".. napasimangot at napailing.. dahil dun ay napilitan ako umkyat 7th floor kahit wala elevator.. pagdating sa 7th floor ay linapitan ko supervisor ko at nagpapaalam ako na kung pwede ay magpahinga muna ako bago ako mag take ng calls pero di sya pumayag.. nasa kalagitnaan ako ng una kong call ng maramdaman ko na may tuloy tuloy na agos ng dugo sa pwerta ko.. pinatawag ko agad ang mga nakita ko sa work area sa bahay namin.. nagkagulo sa work area dahil sa nangyari sa akin.. andun ang boss ng manager namin, ang doctor at mga supervisor... sabi ng doctor bakit daw ako umakyat pero naiyak na lang ako dahil nagalinlangan ako sabihin na binalik balikan ako ng supervisor.. di sila tumawag ambulance.. wala stretcher sa company clinic kaya ibinaba nila ako ng nakawheelchair buhat nila pababa.. sa kotse namin ako sumakay papunta hospital.. matapos nun ay di na nila ako follow-up kung buhay pa ba ako... mula noon ay nagtuloy tuloy na ang bleeding ko kaya nanganak ako ng kulang sa buwan ang bata..

ang tanong.. umaasa po kasi ako na kahit papaano ay liable ang company since sila ang root cause ng problem pero wala sila initiate na offer ng assistance considering di covered ng health benefits namin ang any case regarding pregnancy..pwede ba ako huminge ng danyos sa kanila.. di nakapasok asawa ko sa trabaho dahil sa nangyari at napakalaki ng hospital bills namin plus incubator ni baby.. tulungan nyo po ako.. di ko kasi alam kung may habol ako..

the actuations of the supervisor forcing you to work can be a ground for filing an action for damages.

i am still on medical leave, cani get free assistance from PAO? coz as far as i know the salary must be 14k net but i am earning more than that... how about the company, any liabilities on what happened to me?

what is your status with the company now? did you file for maternity leave?

aside from this, you may also claim from philhealth and the employment compensation commission.

your complaint has a possibility of prospering if you can prove your allegations. if your claim is not more than P100,000, you can file a small claims case against the company. rules on sc.judiciary.gov.ph

yes attorney i am on maternity leave until aug12 but i will be requesting for a leave extension since my daughter needs extra care.. her condition as a premature baby really needs extra attention..

i already filed necessary documents to sss and philhealth but i really would like to demand for a danyos since the incident we had is like a matter of life and death sa amin mag-ina...

any advice po where i can ask free assistance in filing the case kase we have nothing na..ubos sa hospitalization plus napakamahal ng emergency cs and incubator ni baby... need to act on this na... gave birth last may24, ubos na ang budget... help po

if you file a small claims case, you won't need a lawyer. it's not illegal, but it will be uncomfortable to sue your employer while still employed.

where can i file a small claim case po? wala din kasi ako pambayad ng lawyer.. so kung filing a small claim case will not need a lawyer then much better.. and what do u recommend po.. small claim case na lang?

you can first write a letter to your management and ask for reimbursement. rules for small claims are on sc.judiciary.gov.ph

don't fail also to inquire with the employees compensation commission if you are entitled to something. that's separate from sss or philhealth.

..ngayon lang poo nila ako sinagot sa letter ko sa company about my complaint.. pinagssubmit nila ako ng claims for ECP.. i am asking them if i will be getting something from them aside from ecp pero wala pa sila sagot..

please correct me if im wrong po, aside from ecp pwede din naman ako magdemand sa kanila ng danyos perwisyo tama po?

atty. nagsend ang company nmin from HR-LEGAL department ng response sa demand letter ko.. eto po sabi "The internal benefits of the Company do not cover anything related to the said incident other than the mandated benefit from SSS."....

atty.. i need your help.. paano ko po paglalaban na may pananagutan sila sa akin sa nangyari? talagang tinalikuran po nila ang nangyari sa loob ng kumpanya.. help ppo.. plsss

Good Day! Yesterday po, Nov7 nagpasa po ako ng immediate resignation sa trbaho, dhil narin sa payo ng doctor na magpahinga sa condition ko, nagpasa din po ako ng medical certificate to prove it. Kaya lang po snabi nilang irereview nila ito kung pagbabayari po nila ako ng bond na 5,000 or hndi dahil wla akong notice na atlest 10-days para magresign, ng binasa ko po ang contract eto po ang nakalagay : if the employee exits from the compnay under the required 10-days prior noticed and less than 3months from hiring date, he/she will be paid one month after the contract-termination-date and net of training and development, and administrative costs amounting to 5,000. Sa pagkakaintindi ko po ng [he/she will be paid] ay ako po ang mababayaran hindi po ba? May laban po ba ako? ano po ang dpat kong gawin pra makuha ang sweldo ko sa Nov.10, 2011, Nagstart po ako dun ng Oct. 17, 2011, yung half din po ng training fee ko hindi ko pa rin po nakukuha dhil isasama daw nila sa salary ng NOV10, 2011. May chance po ba na makuha ko ang sweldo ko? salamat po.

please see other threads on bonds. if they don't pay your salary, you can file a money claim at nlrc.

Health emergency po ito sa BPO company po na dati kong pinapasukan. Inatake po ako ng highblood habang nasa trabaho at napag alaman ko po na walang clinic at doctor yung company namin. Nature po ng trabaho namin eh pang gabi kaya hindi po maiwasan ang karamdaman. Nung inatake nga po ako eh nag paalam na ako sa manager namin na umalis na at pupunta ako ng ospital dahil hindi ko na makayanan ang hilo at suka na ako ng suka. Hindi po ako pinayagang umalis at ang sabi pa eh nag sisinungaling lang ako. Pa tulong naman po kasi parang na violate po ako eh.
