1 estafa case in the amount of 6thousand pesos, on Sat Aug 13, 2011 10:23 pm

gud day po.ang friend ko ay nagkautang ng 5,000.00 noon juy 2009 at nakapgabyad sya while in saudi ng 1st p[ayment n 4,000.00 then 2nd payment na 4,500.00.nun umuwi ang friend ko this year,june ay may hinahabol pang utang na 6,000.00 ang inutangan dahil daw yun interest.inimbatahan sa barangay ang friend ko ngunit nun time na yun ay wala sya sa bahay.ang ginawa ng inutangan ay sa police station nagpunta at mga pulis na ang nagimbita sa friend ko.pinabalik ng pulis sa barangay ang kaso dahil sinabi ng friend ko na wala na syang utang.hnggang sinampahan ng kasong estafa ang friend ko at sa PAO lumapit.pero before nun ay pinadalhan sya ng demand letter to pay within 10 days nun july 18,2011.nang hindi magbayad ay nagsampa na nga ng estafa case.july 19,2011 naman ng isyuhan ng certificate to file action ng aming barangay ang nagreklamo.nagharap na po sila nun aug.12,2011 sa fiscal at wait na lang daw ng resolution within 5days.ask ko po if legal lahat ng procedures na ginawa ng nagreklamo.ano po ang dapat namin gawin.

procedure wise, it looks ok. but on the merits, a loan is not a basis for estafa

thanks po sa reply.ask ko po uli kung ang PAO ay totoong pwedeng lapitan mng kahit sino,mayaman o mahirap.totoo po bang first come first serve ang pagkuha ng service nila.kasi yun complainant ay una daw lumapit sa kanila nun humingi ng payo sa chief dun kaya from that time on ay client na nila.pano po kung talagang walang kakayahang kumuha ng abugado ang respondent at yun complainant ay can afford.at malinaw din po na nakalagay sa affidavit ng camplainant na siya daw ay nakaluluwag sa buhay kaya nakakapagpautang.pwede po bang ireklamo ng oral defamation at harassment o perjury ang complainant dahil sa kanyang affidavit ay nakasalaysay na ni piso ay hindi nakapagbigay ang respondent ngunit ng may deposit slip sa kanyang bank account (complainant) na ipinakitang evidence ay nag kontra salaysay sya na totoong nakapagbigay na ng payment ngunit ang sinisingil daw nya ay interest lang.thanks po uli.
