hi attorney. hingi lang po ako ng advice. 1 year ago, yung 20 yr old na kapatid ko pong lalaki ay nasampahan ng physical injury to a minor (child abuse), kasi po ay nakainom ang kapatid ko at sinugod ang mga pinaghihinalaang nagnakaw ng cellphone nya na mga kapitbahay. sa pag wawala po nya ay may nadamay na 15 yrs old na binatilyo na naitulak lang naman nya at nagasgasan lang,hindi naman nya sinuntok, dahil hindi naman yun ang sinusugod nya. kumabaga umaawat lang yun bata pero gawa nga ng nagwawala nga, shempre nasaktan din sya. yun magulang po ng batang iyon ay nagsampa pala ng kaso diretso sa piskalya. yun po ay lingid sa kanyang kaalaman. lumakad po ang premiliminary investigation na wala po syang natatanggap ni isang sulat. kaya wala po sya kaalam alam na may isinampa pala laban sa kanya. wala din po syang nagawang counter affidavit. pero recently nga po ay nakatanggap sya nang resolution letter na. dun pa lng po nya nalaman about the case. eto po ang aking mga tanong: 1)ito po ba ay may warrant na? 2) ano po ba ang mga necessary steps na kelangan nyang gawin? 3) nais po namin sanang mag file ng motion for re-investigation, dahil di nga po sya nabigyan ng opportunity na magpaliwanag. ano po sa tingin nyo ok po ba na hakbang ito? salamat po.

moderator
nais po namin sanang mag file ng motion for re-investigation, - this is your best move. you have 5 days to do it from the time you received the resolution.
