the employer's defense was that the truck driver was not dismissed but only placed on "floating" status for he was allegedly banned by two of the employer's clients due to theft. the employer maintains several clients including the 2 clients who allegedly banned the truck driver.
the complaint was filed 3 months after he was dismissed, will the filing of the case be considered premature if he was indeed only placed on "floating" status? what is the reasonable duration of "off-detailing"? are there requisites before an employee can be placed on "floating" status?
