Good day atty. I am a legal wife with two kids 7 & 5 years old. ang asawa ko po ay nasa probinsya nagtatrabaho sa gobyerno bilang agriculturist samantalang ako sa metro manila.
last 2009 po nagkaroon po sya ng girlfriend muntik na po kami magkahiwalay nun pero pinatawad ko po sya. last july 2011 lang po nagkaroon na po sya ulit ng girl friend ibang babae naman po. naka text ko po yong babae nya sabi last May 2011 lang daw po sila nagsama. pero denideny po ng asawa ko na nagsama sila at sabi nya wala na daw sila ng babae.ayoko po sana na masira ang pamilya namin pero last September 10, 2011 nakita po sya ng pinsan nya nasa plaza kasama ang babae. nong nalaman ng father in law ko hinahanap nya ang asawa ko at dun nya kinuha sa bahay ng babae. sobrang sakit po sa akin naapektuhan na po ang trabaho ko.
Puedi po bang i apply ko para sa babae ang article 26 of the civil code of the phils? saan po ako puedi magreklamo?

Yong sa asawa ko, from january to August wala po syang pinadala sa amin ngayong september lang pinilit ko syang magpadala. Puedi ko bang e demand sa kanya ang kalahati ng expenses ng mga anak namin? kunti lang po yong sahod nya. mas malaki po yong sahod ko? paano kung hindi nya kaya yong expenses na hiningi ko. May nabasa din po ako sa forum dito na repeated marital infidelity is considered psychological violence under RA 9262? puedi ko ba sya kasuhan dun? paano ba ako magsimula? kailangan ba sa barrangay muna?

an action based on article 26 is filed in court. if the amount of damages is not more than 100k, you can file a small claims case.

make an honest computation of the needs of the kids and your family, and require him to pay his share according to the ratio of your salaries. send a demand letter first.

repeated marital infidelity will require proof. the case isn't solid but it may survive prelim investigation. i recommend you add a charge of econ violence for the months he did not send support.

Maraming salamat po atty. may follow up question po ako.

1. Ano Po ba ang proof para mapatunayan na may relasyon Sila? Ung unang babae nya po nakita po sila na lumabas galing sa hotel. at kinausap po ng nanay nya na ang babae at ang nanay ng babae. kung sakaling yong cousin ng husband ko mag witness malakas na proof ba yon?
2. Yong pangalawang babae nya yong ngayon kung i apply ko ba yong art. 26 of the civil code kung idideny nila. Puedi ba kaming magkaroon ng kasunduan na layuan nya ang asawa ko.
3. Sinasabi kasi ng asawa ko na 1,500.00 at 1,200.00 lang daw ang net pay every 15th & 30 respectively. kahit bigyan pa daw ako ng payslip. kaya 1,000 per pay day lang ipadala nya sa amin. pero kukuha daw po sya ng motor ulit? ang motor is ang Down Payment 12,000.00 at ang monthly 2,689.00 for three years. alam ko po may mga sideline sya. puedi ko bang e damand yon?
4. Hindi ba ako puedi magreklamo sa employer nya? hindi ko ba sya pueding ipatanggal sa trabaho? since government employee sya? puedi ko bang sabihin sa korte kung hindi nya kaya ang expenses ng mga bata sa amin nalang sya magserbisyo bilang Service ng mga bata, at katulong sa bahay? we can save 5,600 per month sa expenses kung nandyan sya sa bahay kasi hindi na kami magbayad ng service going to school which is 2,600.00 for 2 kids and 3,000.00 for kasambahay.

the person who saw them coming out of the hotel will be a good witness. good evidence are videos, pictures and witnesses.

ask for the payslips, then ask his employer to confirm whether they are authentic, but don't say anything else. i'm sure that is not true.

you can only make him give you money, not force him to live with you if he refuses.

you can still file VAWC for economic violence or a civil case for increase of support.

Hello Atty.,
magamit ko rin bang ebedensya yong text ng babae na nagsabi na last may 2011 pa sila nagsama. at hinahatid sundo sya sa school ng asawa ko? yong text nya po andito pa rin sa inbox ko.

kung sakaling po ayaw mag increase ng asawa ko ng sustento puedi bang sabihin ko na salitan nalang kami ng pagpapaaral kunyari po this year dito ang mag anak ko next year sya naman ang magpaaral. pero sa time nasa akin ang mga bata I will not demand support from him. kung sa kanya naman ang mga bata di rin ako magbibigay ng support. But I will demand na sa private school nya paaralin ang mga anak ko. tulad ng pagpapaaral ko?

you can make any agreement with him as long as the children are cared for
