Hi Atty,

May unpaid bank debt kami na 50K. Last January, tinawagan ko yung collection agency para magbayad ng 25K pero ang sinisingil sa amin is 280K. Ayaw tanggapin ng collection agency yung 25K na paunang bayad. Ang sabi pag ndi ko nabayaran ng buo, magsampa sila ng civil ang criminal case.

I called Makati Metropolitan Trial Court kanina, and confirm nila na may decision na yung civil case ng asawa ko last 2007 pa. Nagtanung ako ng details, sabi need magpay ng 65,000 plus 1% per annum at ang sabi makipag-arrange na lang kami sa bank.

Questions:
1. Alin po ba ang kailangan masunod? yung sinasabi ng Court decision or Collection Agency. Do we have to talk directly sa bank and ask ko settlement?
2. Possible po ba na kasuhan ulit kahit nag-attempt naman kami na isettle?
3. Fair ba yung sinisingil na 280k?
4. Pwede ba mag counterfile ng complaints sa collection agencies dahil sa mga verbal abuse and emotional blackmail na ginagawa nila?

moderator
is the court case the same debt as the collection agency? if so, of course it's the court's decision which will be followed.

you have to file a new case of unjust vexation against the person who verbally abused you.

Follow-up question po:

May timeframe po ba kung kelan dapat isettle yung nakalagay sa court decision na 65k plus 1% per annum? Kasi may sinasabi ang CA na pg ndi agad masettle pwedeng-pwede silang magfile ng criminal case kasi may decision na daw ang civil case. Possible po ba ito?

they have 10 years to have the decision enforced.

they can file a criminal case, but it depends on the evidence whether it will prosper

how is it possible that a person who signed a contract to pay a certaine amount of interest per month on a loan and if he doesnt do it for 2 monthly payments he breaches the contract he is in default be able to avoid payment and I cant foreclose

foreclose? did you have a written mortgage agreement which empowers you to be an atty in fact to sell his property?

hi po..ask q lng po ako at ung co workers ko nagamit namin ung pera n para s kanya dhil ito ay padala s knya..alam namin n mali kami pero ndi naman namin tatakbuhan ung pera ginamit namin worth 27,400..nag filed cia ng estafa s atty. nia pero pinagawa nia kmi ng sulat n kung kailan namin babayaran..pwede po b mabali wala un sulat n ginawa namin at ituloy n lng nia demenda..ilang taon po b ang jail s estafa at may bail po b ito?

i believe that is the crime of falsification. i recommend you do everything, even borrow, just to pay that debt asap and get

hi atty..another question f ung girl nirecieve n nia ung partial payment namin para s pera nakuha namin may grounds p b cia ituloy ang kaso namin..kahit tumanggap n cia ng unang hulog smin dhil un ang napagkasunduan n hulugan cia..anu po gagawin namin..thanks

please don't use text spelling. down payment will not remove criminal liability unless there is a clear written agreement.
