Arresto Menor
Hello po. Nagpapahiram po ako sa mga officemates ko ng pera sa interest na 10% fixed each month. Problema may ibang puro salita nalang at umabot na ng isang taon, sa mga nabasa ko po sa forum papapirmahan ko po sila ng contrata at pag hindi nasunod sa baranggay na po kami maguusap, tama po ba. Ayaw ko na pong paabutin next year ung utang nila.May trabaho po sila at kasama ko sa office.

Questions:
1. Pwede ko bang ilagay sa kontrata agad na pwede silang magbayad in goods to pay ung balance nila at pag hindi nabayaran eh kukuha ako ng gamit nila para pambayad?

2. Kapag hindi ba nakapagbayad ung tao paglampas ng due date nya sa papel pwede ko na ba sila ipakulong, balak ko sanang sa kulungan sila magpasko para maghirap naman sila.

3. Meron akong isang napautang na nasa abroad na nagtratrabaho pwede ko pa ba sha habulin may evidence naman po ng paguusap namin sa facebook kaso wala kaming kontrata sa papel?

first of all, if this reaches the courts, it will not allow you to charge 10% because it is too high. and if you don't have a written agreement now, they are only obligated to pay the principal less previous payments.

failure to pay a debt is not a crime. but you can file collection cases against them.
