Good day po.
Thank God dahil nakita ko po ang site nyo at nagkaroon po ako ng pag-asa para masagot ang problem ko about my Birth Certificate.Here's my problem and hopefully you can answer po...

Since childhood I'm using my full name Antonette Benoza De Jesus,pero nung 2008 nalaman ko po na Antonette Benoza lang ang nakalagay sa BC ko sa NSO copy.Una po nagfile po ako ng LEGITIMATION, pero hindi po naapproved dahil nakita po na may unang kasal ang mom ko sa x-husband nya 28 years ago.Tapos nagfile po ng R.A 9255 pero nalaman ko po sa NSO na hindi na po ako sakop ng R.A 9255 dahil 1986 po ako pinanganak.Nung pinarehistro po ako ng mama at papa ko nung 2008.Purmima naman po ang papa ko sa likod ng BC ko ng Affidavit of Acknowledgment/Admission of Paternity.Kinasal po ako nung 2010 at hinayaan ng registrar na pagamit sa akin ang Antonette Benoza De Jesus sa MC ko. Ngayon po naging conflict po ang BC at MC ko dahil sa BC ko Antonette Benoza lang po while sa MC po nagamit ko po ang full name ko.Ang tanong ko po sana if may other way pa po ba para magamit ang last name ng papa ko na DE JESUS kesa adoption proceedings po ang pagagawa sa akin.wala naman po kami ganung kalaking pera para dumaan pa po sa korte at nasa tamang edad narin naman po ako...Sana po may maiadvice po kayo ng other way na hindi na po gagastos ng ganun kalaki...Maraming maraming Salamat po...Sana po matulungan nyo po ako...More power po..

i recommend you try the ausf under ra 9255 path again. the law did not distinguish between children born before or after the passage of the law.

you think all them revillas were born after 2004?

Atty.LLL, sa totoo lang po...dalawang beses ko na po ginawa ang ang AUSF or R.A 9255...Sad..pero hindi parin nila ako inallow ..Sad..sinasabi po nila pinanganak po ako nung panahon ni Pres. Cory..dahil my pinatupad po daw ang presidente nun na, hindi pwedeng gamitin ng anak ang surename ng tatay kung hindi kasal ang magulang...AttyLLL...kung alam nyo lang po..ilang beses po ako balik ng balik ng NSO manila...pero talagang ganun pa din po sinasabi sa akin at adoption proceedings lang po daw ang way para magamit ang last name ng papa ko....kaya po desperate akong naghahanap talaga ng matatanungan about sa problem ko online..Sad..Pero Thank God po talaga dahil sumagot po kayo...


AttyLLL, d ko po alam kung susubukan ko pa po ung AUSF..kase twice ko na po ginawa pero wala pa din po nangyari...Sad

Ask ko lang po may other way pa po ba maliban sa adoption proceedings or ung AUSf???

AttyLLL...nagsesearch nga po ako ngaun about R.A 9255..at nabasa ko nga po na nakalagay is

Rule 1. Coverage


1.1 These Rules shall apply to all illegitimate children born before or after the effectivity of R.A. 9255. This includes:

1.1.1 Unregistered births;

1.1.2 Registered births where the illegitimate children use the surname of the mother....


Atty...tanong ko na lang po...kung saan po ako pwedeng dumiretso kung sabihin po sa akin uli ng mga tumitingin ng documents sa my NSO na hindi nanaman ako sakop nung R.A 9255...I really appreciate po if matulungan nyo po ako...Gusto ko po kasing subukan sa pangatlong pagkakataon...hopefully maayos na po this time...Maraming Salamat po...

i recommend you write a letter addressed to the civil registrar and quote the provisions so that you are not blocked by some clerk. make sure you have a receiving copy.

if you can afford it, engage a lawyer.

Good day Atty...talaga po ayaw ng paggamit sa akin ung R.A 9255...Court order na po talaga ang way para magamit ko po daw ang last name ng papa ko...Sad...Dahil po dinala ng taga-apalit(MCR) ung lahat ng feedback ng nso sa NSO edsa...at ang sabi po court order ang kailangang gawin...ask ko na lang po sa inyo alam nyo po ba how much ang magagastos at gaano po katagal itong adoption proceedings para po makapag ipon po ako...maraming salamat po...

ok, wait. i re-read your facts, and that little tidbit about your mom having an ex-husband escaped me before. do you mean that when you were born, your mom was married to someone else other than Mr. De Jesus?

What is Benoza, your mom's married or maiden surname?

opo kasal po si mama sa unang asawa nya(Mr.Ramos)....pero napag-alaman po ni mama na hindi RAMOS ang last name nung lalaki kungdi LAPINID(nalaman nya po mismo sa tatay nung 1st husband nya)..at nung puntahan po kasi nya sa cebu..nakita nya na may kinakasama na palang ibang babae,kaya hindi na sila inuuwian sa pampanga nun...in short talagang niloko lang po ang mama ko...

pero nung pinanganak po ako year 1986,,,matagal na po silang walang communication nung unang asawa nya...ang papa ko narin po kasi ang nagpalaki sa dalawang anak nila...6 months palang ang half brother ko..si papa ko na ang nagsustento sa kanila at nag-ako sa responsibilidad ng tunay nilang tatay...nung 2008 po kinasal po nang civil si mama at papa...at my copy po sila ng MC sa NSO...alam ko po na void po un dahil di po naapproved ung legitimation ko po...at ung R.A 9255 sinasabi nilang hindi na ako sakop nun kaya ayaw na po nilang pagamit sa akin...at court order na po daw talaga ang way para po magamit ang last name ng papa ko na DE JESUS...Sad

at ung BENOZA po yun po ang ang Last name ni mama sa pagkadalaga...


atty. magkano po ba gagastusin sa court order at gaano itatagal? para alam ko po kung sakaling gawin po namen...at para mapag ipunan po..maraming maraming salamat po at pasensya na po..kayo lang po talaga ang makakasagot sa problem ko...Godbless...

ok, i apologize that i missed that point. ra 9255 will not apply because you were born when your mother's marriage was still subsisting. by law, your last name should be her husband's last name.

there is no clear legal remedy. change of name is possible, but legally a long shot.

i'm a 32 yr.old single mom,my 14monthold son is using my surname and is not recognized by his biological father. I am getting married (Marriage for Convenience)this coming summer, i wanted my fiance's name on my son's birthcert in exchange of marriage so he can have a immigrant visa here in Philippines. We know that adoption is kinda expensive and long process. Is it possible/legal if instead of adoption,he will just get ''acknowlegment of paternity'' I'm afraid that they might ask for DNA if a applied for my kid's visa for travel in UK. All i want is my son's best interest even if it takes my marital status, i dont intend to marry anyways. What i want for him is a Surname he can use so he can avoid social embarrassment. Please try to enlighten my mind.

good day po atty.LLL. kakasign-in ko lang po,it just so happen na pareho po kame ng problem ni rockann15,ang pagkakaiba lng ako po ung mother na may problema kung papano maililipat ang apelyido ng anak ko sa father nya who is my husband of 19yrs. now.presently iam in a process of annulment to my 1st husband who, untill now resides in America for over 2 decades.dont know his whereabout.nakapagpakasal ako in civil dito sa present husband ko last 1993 after giving birth to our first born last1992,sa pagaakala namen na un ang mabuting gawin para automatically nasa pangalan na nya ang anak namen nalegitimize sya sa cityhall, ng kukuha na kame ng copy last 2008 sa nso.nakita na nasa surname ko sya,at nakita sa feedback that the mother has 1st marriege.so ra 9255 was the solution but we have to cancel the legitimation para maapply daw ang ra9255 nakapagtanong din po kame sa ibang lawyer pero ibaiba po sila ng advice.icancel daw ang marriege namen ng present husband ko.pero pano po un ? Atty. kung sakali poba na maapprove ang annulment ko kelangan ko paba magundergo sa mga ganitong proceedings or my annulment will free me to any legal matters .gusto ko napo maisaayos ang papers ng mga anak ko ayoko po sila magkaroon ng problema pagdating ng panahon.pero diko po alam kung saan ako magsisimula, please help me.i will appreciate any help.pasensya napo sa haba ng mail ko,,we will wait for ur reply.thanks and regards,,
