good day atty,
I have a cousin who recently applied for a NBI clearance (naglakas loob) last Monday. Ang scenario po eh may hit sya ,w/c is expected kasi, dinawit sya sa illegal recruitment case na nai-file sa kanila ng mga applicant daw nila before (by the way this was since 2004 pa daw po). January 2005 may narecieve syang resolution na indictment by court na 2 lang sila ng boss nya before sa kasong illegal recruitment & large scale stafa. (parang nagkaron ng speedy trial dito atty kasi walang subpoena daw syang narecieve. Then by March 2005 meron ulit resolution na 6 persons clang na nireklamo (eto daw po naka pagfile sya before ng counter affidavit) ung 3 po including ung cousin ko eh dinismissed ung case sa kanila ng prosecutor, kasi wala daw po silang direct relations sa issue ng pagdispalko ng placement fee daw ng mga applicant. Ang tanong ko po eh, papasok po ba ung ruling na Double Jeopardy dun. kasi po may verdict naman cya n dismissed? & ung sa court clearance na request ng NBI sa kanya eh iba din po ung case # is it also possible na magfile lang magfile ng case ang mga applicant nila before kahit may ruling nga ng dismissed na ung isa nyang case na may same allegation lang. Hope to read a reply from you atty, naaawa po kasi ako sa cousin ko na personally alam kong wala talaga syang kasalanan dun. its been 6 years yet wala po syang mapasukang trabaho. thank you atty in advance.

was he arraigned in any of these cases which was dismissed by the court? if not, there is no double jeopardy.
