hi. i am married for 8 years with 2 children. i recently found out accidentally through text messages that my husband has a mistress and what's worse is that he got her pregnant! the mistress knows that my husband is very much married and she knows me.
I was really suspecting months ago that he was having an affair because he seldom comes home and his reason was that he was doing business in the province.
two weeks ago, he gave this celphone to my mother and that celphone was previously owned by his mistress (his mistress gave the phone to him which he then gave to my mother). so i found out through that, that they were indeed having an affair and the mistress was pregnant.
The other problem is that my in laws (his sister and parents) know about this and made "kunsinti" my husband and the mistress.
this was the second time that my husband cheated on me with the knowledge of my in-laws pero hindi naman po nabuntis yung sa unang panloloko nya.
the mistress is a doctor and is now hiding from me and i asked my husband not to come home anymore.
My questions are:
1. what can i sue them both (mistress and husband) for this?
2. Can i possibly also sue my in-laws because they were making "kunsinti"my husband and the mistress.
3. can i have the mistress'
license as a physician be removed because of this?
4. or can i only sue the mistress for this and possibly not my husband?
i hope to get an immediate and favorable response from you.
Thanks you so much and God bless you always.

i recommend you get additional and better evidence aside from text messages. in any case, evidence is the most important.

you can sue your husband for repeated marital infidelity under ra 9262.

if you can prove they are living together, you can file a case concubinage against them both.

you can file a case for monetary damages against the girl for disturbance of your family affairs.

as with my other clients, what i normally do is to send a letter to let them know that you know and that you do not give your consent. but that should be done only after there is sufficient evidence complied.

there is actually no specific provision on RA 9262 preventying a mistress from filing a case against the man.. so for as long as violence was committed to her either, physical, sexual, psychological or emotional I think she may also sue your husband provided she will prove that violence was inflicted upon her...
