Good morning attorney, we have a problem and this is the scenario, binundol ng motor ang multicab na minaniho sa aking kapatid, to make the story short, namatay yung nakabundol, at sa police report,traffic investigator at sketch, siya ang may sala at wala pa sa kanyang lugar. ang tanong namin. maka demand ba kami na ipapaayos yung sasakyan namin na namatay yung nakabundol nya where infact walang linsesnya tapos sa kanyang kapatid yung motor pero may rehistro. kung pwede kaming bayaran sa kanila bang motor insurance or sa aming insurance? ang insurance po namin ay TPL. Ano ang dapat naming gawin attorney kapag hindi kami nila babayaran o ipapaayos lang talaga yung motor?.. ( salamat pala Atty. kasi sinunod ko yung advice mo dati)

@brett0486... advised lang po.. namatay un nakabundol sa sasakyan nyo then u want to suet for damages on your vehicle.right? if i am you, just shoulder it by your own, namatay na un tao, accidenty lng ang nangyari, accident comes when u less expected... abuloy mo nlng sa tao un itutulong nila sana sau na pang repair ng vehicle mo... but if u want to file a case sino fifilan mo un namatay? nope d ba, ang hahabulin nyo is un relatives ng namatay then it will be civil case.. cguraduhin mo lang na may kakayahan o may perang pambayad and sinusuet nyo if not, kayo ang magagastusan... :-)

you can claim damages from the vehicle owner if it can be proven they were at fault.
