i've been with the company for morethan 4 years. before ibang category ang excessive tardiness and overbreak pero pinagsama na po nila recently sa company policy
1st offense-written reprimand
2nd offense-written warning
3rd offense-final written
4th offense-dismissal

ang question ko po dapat po ba magkasama ang overbreak and excessive tardiness? meron na po kasi ako prev ir's for excessive tardiness kaya nung na overbreak ako nagissue ung manager ko ng for dismissal. pero po ung ibang naoverbrreak hindi po nya binigyan ng ir.

Another question ko po is it legal ang schedule ko po morethan 8 hours per day(reg pay lang po un)ang shift ko po 4 days a week 11 hours a day including 1 hour lunchbreak, pero 3 po ang rest day ko. Pwede ko rin po ba ireklamo ung manager ko dahil sa power tripping..Matagal na po nya kasi ako pinagiinitan. Thank you.

extended work days are allowed if for 4 or 5 days a week if it was reported to the dole.

overbreak and tardiness can be argued as not the same. but if there are too much of either or both, you can be terminated.

Atty. need ko lang po ng advise
1st offense po- overbreak (sept 2011)
2nd offense-nalate po ako (sept 2011)
3rd offense-na late po kasi ako ulit (nov 2011)
4th offense for dismissal (dec 02 2011)

anu po recommended na gawin? dapat na po ba ako materminate? pag nagfile naman po ako ng resignation kelangan daw po ako mag render ng 30 days pero pag nauna po ung resolution mateterminate daw po ako.

moderator
i would argue that 4 instances are too few to warrant dismissal considering you have been there for 4 years.

your remedy is to file a complaint for illegal dismissal at the nlrc
