tanong ko lang atty kung valid ba ang ginagawa ng head office namin sa amin, 1st is yung pag hold ng salary namin. sa branch po kasi kami naka assign and ang communication namin is thru skype lang. ang cut of namin is from dec 21-jan 5 supposed to be jan 10 sasahod na kami pero hindi po dumating ang payroll namin, ang sabi sabi ng ibang branch kaya daw nahold ang salary is dahil daw sa poor performance ng branch? pwede po ba ihold ang salary dahil sa ganun reason? pag tinatanong po namin ang head office about sa salary namin na delayed na ay hindi po nila kami sinasagot ng maayos, basta daw po antayin lang namin. 2nd atty is yung gusto nila na mag overtime kami ng wala naman tamang protocol, the last time ay tumawag sila for branch call pass 6pm na, ang official working hours namin ay 9-6pm so umuwi na po ako, then binigyan ako ng memo bakit daw po wala na ako nung tumawag sila-wala naman po masama na umuwi na ako dahil uwian na po and wala naman po dumating na memo na kailangan namin mag overtyime, tapos po yung kasama ko sa office pinagreport nila thru phone till 8pm tapos wala daw po overtym pay yun, which is mali..atty ano po mag labor code ang nilalabag ng company namin? pati po ang petty cash namin na pinagkukuhanan namin for everyday use hinohold nila tapos gusto nila kami magremedyo ng para sa daily expenses ng office..atty pano po kung bigla nila kami isuspend ng wala naman talaga reasonable grounds? the fact na nagbibigay pa sila ng memo to explain na obvious sila ang may pagkukulang..

and atty, may karapatan po ba kami tumanggi sa pinapagawa nila na wala naman po sa job description namin, kasi po sa company namin madalas hindi nagtatagal ang branch manager dahil narin po sa patakaran nila, ngayon kami po na naiiwan na cashier gusto nila na kami ang gumawa ng mga trabaho ng branch manager habang wala pa sila, like pag gawa ng reports, mag update ng mga customers etc na wala naman talaga sa job description namin na mga cashier..at kung hindi po kami sumunod ay memo na naman po ang binibigay nila sa amin

honneyche, your remedy is to file a complaint at dole so that the company will be investigated. you can include the complaint about the additional tasks.

thanks atty. may i also ask kung sa dole or nlrc kami magreport ng mga violations ng company para mainvestigate? i am not doing this for my self atty kundi para din sa mga co employees ko na nagwowork sa different branches ng company namin.

And if i file illegal suspension sa 7 days ko atty, maging ground ba eto para iterminate ako? and ano po ang remedy sa illegal suspension?

yung reason nila sa suspension memo ko is mali talaga atty, i think gumawa nalang sila ng ibang version para ma justify nila na maisuspend ako..hindi rin yun ang sinulat ko sa reply ko sa memo ko pero still iba parin ang inilagay nila na reason.

atty i need an advice regarding the estafa case that is on going para samin ng asawa ko and nangyari kasi po is yung position ko po is cashier tapos dahil yung kompanya po ay walang data base para magamit sa pag hanap ng tamang due ng customer npabyaan ko po yung trabaho ko kakagawa ng manual na pag gawa ng excel data base and on going migration ng data na kailangan ng focus dahil kung hindi ay hindi yung mattapos sa talaan n 6 n buwan n serbisyo ng programmer hindi sila ngahihire ng additional employee dahil nagtitipid dahil bago lng daw and isa pa multiple work po ang pinapagawa sakin pati mga personal na kailangan nila sa bahay or sa ilang mga sideline ng boss ko sa madaling sabi po all around na nagaaudit, nag cashier, secretary, treasury , hrd minsan janitor pa. halos lampas n sa 8 oras ng trabaho araw araw ang ginagawa ko and dahil sa sobrang load ng trabaho naiipon yung mga dapat ichek pareho po kmi empleyado sa kompanya ang hindi ko alam yung asawa ko hindi na pala dinideposit yung pera umabot ng mahigit 200k ngayon po ininform ako ng opisina na magfifile sila ng case sa asawa ko and isasama ako tma po ba yun?
