Arresto Menor
Can you please advise the process for filing for presumed death.

My partner has been seperated now for 10 years with zero contact. We have made all attempts to contact parties in Singapore to discuss divorce however we have had no success in ocating the ex-husband. On this note we will file for presumed death and take the risk of getting married on this basis.

In the case that the ex husband is not dead, the fact that he has been absent without contact for 10 years, there is no children of financial ties, I dont think he will re-appear in Manila and file affadavit of appearance.

Is it possible for us to file our own Presumption of death case. If so what is the procedure and process.

what is required is that you prove there is a good faith basis to believe he is dead. you have a good start. you should also inquire with his local relatives; allege also that you did a internet search
